Beyer Construction, Inc. Tax Map/Parcel: 78/93 (Section 1, Phase 1, Lot 14) Acreage: .973 Zoning: PRD (Planned Residential Development) Location: End of Cul-de-sac on Walnut Lane VARIANCE REQUEST The applicant requests relief from Section 19.9.2 of the Albemarle County Zoning Ordinance to allow a single-family dwelling to be located 6 feet from the rear property line, a variance of 44 feet. AREA CHARACTERISTICS There are slopes of 10 to 20 degrees plus located on Lot 14. There is a wet weather drainage swale that exists on the lot, and a smaller swale that leads to the larger one. The lot is wooded, as well as Lot 15 which at present is vacant. A residence is located on Lot 13. COMPREHENSIVE PLAN The Urban Land Use Plan indicates this area for medium density residential development. AGENCY COMMENTS Any construction of a residence would be subject to Health Department approval for the location of the septic system. The lots in the subdivision can be served by a central well system. ZONING HISTORY Variance, VA-83-58, was approved by the Board of Zoning Appeals to allow relief from Section 6.5.01 to allow a single-family dwelling to be located 42 feet from the front property line, a variance of 8 feet. Variance, VA-83-59, was approved by the Board of Zoning Appeals to allow relief from Section 6.5.01 to allow a single-family dwelling to be located 25 feet from the front property line, a variance of 25 feet. Variance, VA-84-03, was approved by the Board of Zoning Appeals to allow relief from Section 19.9.2 to allow a single-family dwelling to be located 46 feet from the front property line, a variance of 4 feet. STAFF COMMENTS In review of the three variances approved in Ashcroft Subdivision only the one for Rinehart Construction VA-83-59 was really involved with topography. If the attached garage were not added the house itself would have only encroached one foot plus over the setback requirement. The setback of the house with garage located at the required 50 foot setback would have put the septic drainfield area in jeopardy. "raw Iwo STAFF REPORT - VA-84-30 Page 2 The Zoning Department has established a procedure to review all lots for build- ing setbacks, and for topographic problems before the building permit's issued. In turn the Architecture Review Committee has to approve the location of all residences in the development. STAFF RECOMMENDATION The lot has a very limited building area. The drainage swale separates the two most suitable building sites. Good construction practices steer you toward the area located adjacent to the common area. To place the residence in an area located adjacent to the common area. To place the residence in an area that is subject to considerable run-off warrants consideration. The staff recommends approval of the variance due to topography of the lot (specifically the drainage swales) . The location of the house near the common area will not have any adverse effect on the adjacent properties. For future variance applications of this nature detailed topographic maps will have to be furnished so that the staff and Board will have a more precise description of the property's merits. STAFF REPORT - VA-84-30 Applicant: R.L. Beyer Construction, Inc. AREA CHARACTERISTICS There are 25 degree slopes located on lot 14. The most suitable building sites are located to the rear of the lot. To the rear property line is an area des- ignated open space. Residences are located on the adjoining lots. The appli- cant's lot is wooded, and does have some natural drainage areas which limit both the location of the dwelling and the septic system. COMPREHENSIVE PLAN The Comprehensive Plan indicates this area for medium density residential de- velopment. AGENCY COMMENTS Any construction of a residence would be subject to Health Department approval for the location of the septic system. The lots in the subdivision can be served by a central well system. STAFF COMMENTS As required by the Ordinance, no structure shall be located on slopes of 25 percent or greater. Also, the septic system should not be located on more than a 20 degree slope. This lot is located at the end of the Cul-de-sac which physically receives a lot of natural drainage due to the open (not wooded) lots above. There are other lots in the subdivision which have the same physical charac- teristics, so this situation is not unique. STAFF RECOMMENDATION The Ordinance is not unreasonably restrictive but more so the lot has very limited building area. We feel that the lot is almost unbuildable at the required set- backs. The area that the variance will have the most impact on is open space, which should not be affected. We make a favorable recommedation.
