Brown Tax Map/Parcel: 126/28C Acreage: 3.51 acres Zoning: Rural Areas, RA Location: At northwest side of intersection of Route 6 and Route 630 in the Scottsville District VARIANCE REQUEST The applicant requests relief from Section 10.4 of the Zoning Ordinance to allow a residence (second use) to be placed on 3.51 acres, a variance of .49 acre. AREA CHARACTERISTICS The applicant's property is located in an area that is sparsely developed with single family residences. The property is relatively level with no dramatic slopes. The applicant operates a public garage located immediately at the in- tersection of Route 630 and Route 6. Several residences are located to the north of this property. ZONING HISTORY The applicant operates a nonconforming public garage which was cited with a "junk car" violation in 1982. This violation has been abated and the applicant has worked with the County to improve the condition of the site. COMPREHENSIVE PLAN The applicant's proposal does not significantly impact the Land Use Plan. AGENCY COMMENTS None STAFF COMMENTS The applicant proposes to place a mobile home toward the rear of the public garage. This would constitute a second use on less than 4 acres of property. This case relates directly to the Special Staff Report pertaining to when a variance is construed as a rezoning. The applicant's proposal in effect would change the density requirement of the Zoning Ordinance and would be tantamount to a rezoning. It is my understanding that you have gone out to the property to help lay it out for him so there won't be any question as to what he is asking for. I would appreciate it if you would please give me a call at your earliest convenience so that we can discuss what, if anything, I need to do to assist Mr. Brown. It is my further understanding that there is a meeting set at the County Office Building at 3: 00 p.m. on May 8 , 1984 . Any thoughts you can give me as far as how to best present Mr. Brown' s case at that meeting, would be appreciated. I look forward to hearing from you in the next several days .
