Eicher, Jr. TAX MAP/PARCEL: 42/10 (part of) ACREAGE: 14.522 acres ZONING: Rural Areas, RA LOCATION: Off Route 675 adjacent to Albemarle Lake Dam VARIANCE REQUEST The applicant requests relief from Section 10.4 of the Zoning Ordinance to allow construction of a livestock barn to be located 36 feet from the front property line, a variance of 39 feet. AREA CHARACTERISTICS The applicant's site is sparsely developed with single family residences. The property is located immediately adjacent to the Lake Albemarle spillway. The topography of the site slopes up to a large knoll that dominates about half the site (see attached topo map) . ZONING HISTORY None COMPREHENSIVE PLAN The proposed use complies with the Comprehensive Plan. AGENCY COMMENTS Not Applicable STAFF COMMENTS The applicant proposes to construct a livestock barn 36 feet from the front property line. Topography of the site is not an issue as evidenced by the attached topo map. Also, a lack of lot area is not an issue either because the barn can be easily placed on another site within the required setbacks. Upon discussion of this case with the applicant's representative, the staff can perceive no hardship. It is the staff's opinion that the proposed location is one of convenience. Mere inconvenience to the applicant does not constitute an unnecessary hard- ship and to grant a variance in such case would be construed as a special privilege.
