Morris TAX MAP/PARCEL: 46/74 ACREAGE: .340 ZONING: Rural Areas, RA LOCATION: 2/10 mile west of the intersection of Rt. 649 and Rt. 743 VARIANCE REQUEST The applicant requests relief from Section 10.4 of the Zoning Ordinance to allow a garage to be located 34 feet from right-of-way, a variance of 41 feet. AREA CHARACTERISTICS The property is a small lot that slopes toward Route 649. A modular home is located on the lot, and the applicant proposes to build a detached garage. Going east, residences are located on both sides of Route 649. A church is located across the road from this site at the intersection of Route 741. ZONING HISTORY The Board of Zoning Appeals granted relief from Section 10.4 to allow a single-family dwelling to be located 25 feet from the front property line, a variance of 50 feet; and to be located 25 feet from the rear property line, a variance of 10 feet. The modular house replaced a nonconforming mobile home. COMPREHENSIVE PLAN The variance will not be of any impact because the residence is existing. STAFF COMMENTS The ordinance requires setbacks from roads to allow for future improvements as in this situation which might become a reality. If the road right-of-way is increased, it would then diminish the distance from the structure to the road. STAFF RECOMMENDATION This lot, because of shape and area, limits the physical location of ad- ditional structures or an addition to the existing structure. In review of the physical location of the house, well, and septic system; very minimum space for construction is left. To meet a 75 foot setback does restrict the use of the property. The staff makes a recommendation for approval subject to: 1) Applicant locating the proposed garage structure as far back from the road, but within the rear line setback of 25 feet 2) That no future expansion be allowed. _ F ; -3i L ; 44.
