ONLY BE DONE BY LOCATING IT WITH THE PRESENT STORAGE. THE SCALES, MIX & LOAD OUT EQUIPMENT, AND
A POWER POLE ARE LOCATED AT THE NORTH END OF BUILDING. THE ADDITIONAL BIN IS NECESSARY TO STORE
BULK LIME IN A DRY PLACE. ONCE LIME BECOMES WET IT MUST BE MIXED WITH DRY LIME BEFORE IT CAN BE
SPREAD. FERTILIZER AND LIME FACILITY IS LOCATED AT BACK OF PROPERTY WHERE IT CAN NOT BE 5E4 FROM
THE HIGHWAY OR BY THE PUPLIC AND IS ENCLOSED BY A 6' FENCE.

APPLICANT: Spangler Farm Supply, Inc.

LOCATION: East side of Route 20 approximately . 2 mile from
its intersection with Route 726
VARIANCE REQUEST
The applicant requests a variance from Section 21 . 7 . 2 of the Zoning
Ordinance to allow an addition to storage facilities to be located
34 feet from an adjacent residential district, a variance of 16 feet.
AREA CHARACTERISTICS
The applicant operates a nonconforming farm supply business (since
1971) . The area is sparsely developed consisting of large parcels
of land. The applicant' s property is bounded by property zoned HC to the
north and RA to the south and rear of the property.
ZONING HISTORY
The applicant received approval to rezone this property from Village
Residential, VR to Highway Commercial , HC on June 17, 1981 . The
reason for the rezoning was to allow for expansion of commercial
uses that were restricted by the VR zoning.
COMPREHENSIVE PLAN
The applicant' s proposal conforms to the Comprehensive Plan.
AGENCY COMMENTS
None
STAFF COMMENT
The applicant proposes to build an additional 16 foot lime storage
bin onto the existing fertilizer storage facility. He is restricted
from building the new bin on the north side of the existing storage
facility because his scales, mix and load equipment, and a power pole
would all have to be relocated. This portion of his operation is
located to the rear of the property away from Route 20 .
STAFF RECOMMENDATION
It is the staff ' s opinion that the site is restricted due to the
physical development of the site. The staff is of the opinion that
the strict enforcement of the Zoning Ordinance would unreasonably
restrict the use of this property. Also, the applicant' s problem is
unique in that it is not common to other propertied in the area.
Based upon the above, the staff recommends approval of the requested
variance.
