AREA CHARACTERISTICS The applicant ' s lot is one of two large lots located at the end of the Cardinal Ridge Road. The lot slopes downward from the road toward the house. The solar collector is positioned in front of the swimming pool which is located just beyond the 75 foot building line. The residence is about 120 feet from this swimming pool. A drainage easement lies to the rear of the swimming pool . A portion of the applicant ' s lot lies within the flood plain of the Mechums River which flows across the north east corner of the lot . Residences are located on the adjoining properties. COMPREHENSIVE PLAN Comprehensive Plan designates this area as Open Space (Rural Areas) which allows a maximum density of one dwelling per two acres. STAFF COMMENTS As provided under Section 10.4, all structures are to meet a 75 foot setback from the road right-of-way. No yard existing at the adoption time of this ordinance (December, 1980) shall be reduced unless such requirements reduce the buildable area to unreasonable dimensions - Section 2. 1.5. In such cases, the Board of Zoning Appeals shall determine the minimum requirements consistent with provision of adequate light and air, prevention of loss of life, health, or property from fire, or other dangers, and prevention of danger in travel . STAFF RECOMMENDATION The swimming pool is located just beyond the 75 foot setback line. The solar collectors are to provide the heating source for this pool. One of the highest points on the parcel is located adjacent to the lot frontage. To obtain the best southern exposure the collectors would have to be placed at this location. STAFF REPORT - VA-84-43 The collectors could have been located further back but still required a variance. The collectors are not readily visible from the road and adjacent residence. We do not think it would be a detriment to the adjacent properties. The placement of the collectors does somewhat restrict the use of the property. Not being able to locate the collectors at the best exposure is a hardship.
