L A's:'n • .) rJ c • C^1 s> OQ �+ •• •7.tea 9 STAFF REPORT - VA-84-50 APPLICANT: Cecil W. & Minnie/ John & Shirley Gribble TAX MAP/PARCEL: 115/47D ACREAGE: 5 acres ZONING: Rural Areas (RA) LOCATION: North side of Route 618, approximately .6 mile east of the intersection of Route 618 & Route 620 VARIANCE REQUEST: The applicant requests relief from Section 10. 4 of the Zoning Ordinance to allow a parcel to be subdivided with 131.87 feet of road frontage, a variance of 118.13 feet , and the applicant also requests relief to allow an existing mobile home to be located approximately 38 feet from a right-of-way, a variance of 37 feet . AREA CHARACTERISTICS The applicant has a parcel of land that was recorded prior to the adoption of the Ordinance in 1969. There is a mobile home located on the front part of the parcel approximately one hundred (100) feet from the road. A Special Permit , SP-142A, was approved by the Board of Supervisors on October 1971 , to locate a mobile home on Tax Map 115, Parcel 47C with conditions of 100 foot setback, and Health Department approval of septic system. A Special Permit , SP-378, was approved by the Board of Supervisors on August 1974, to locate a mobile home on Tax Map 115, Parcel 47C with the following conditions (A) County Building Official approval (B) minimum setback of 100 feet from Route 618 (C) removal of as few trees as necessary (D) skirting around both mobile homes from ground level to base of mobile home (E) five year time limit (F) this permit is issued to the applicant and is not transferable (G) the mobile homes are limited to the occupancy of a single family and the two trailers should be a maximum of 16 feet apart . There is a stream that flows aeross the rear of the applicant ' s proposed lot #2. The immediate area is partially developed with a residence and vacant land. ZONING HISTORY The Board of Supervisors approved SP-05 on August 21, 1969, to locate a mobile home on Tax Map 5, Parcel 47. The Board of Supervisors approved SP-43 on June 18, 1970, to locate a mobile home on Tax Map 115, Parcel 47 with conditions - 1) Health De- partment approval of septic system 2) and a setback of 30 feet from right-of-way. 3) The Board of Supervisors approved SP-071 to locate a mobile home on Tax Map 115, Parcel 47 subject to Health Department approval of septic system, and annual review by Zoning Administrator, and the joining of the two mobile homes together. STAFF REPORT - VA-84-50 Page 2 Report - one mobile home located on property. COMPREHENSIVE PLAN This area is designated for Open Space (Rural Areas) which allows a maximum density of one dwelling unit per two acres. STAFF COMMENTS The Ordinance per Section 10.4 requires a minimum 250 feet of road frontage to create a lot . Lot-1 having road frontage of State Route 618 and the proposed 20 foot right-of-way makes it a corner lot . The setback from other roads shall be 80% of the front yard setback (75 feet) thus 60 feet . STAFF RECOMMENDATION The applicant ' s property is less than 132 feet in width, therefore , not wide enough to provide the 250 foot width required. A 20 foot right-of-way has to be created to serve the rear parcel . The ap- plicant has the option of putting a second dwelling on the existing 5 acre parcel by right . This right does not restrict the use of the property. Because the narrow parcel was created before the 250 foot requirement came into effect , it does not qualify as a hardship.
