VARIANCE REQUEST
The applicant requests a variance from Section 10.4 of the Zoning
Ordinance to allow a single-family dwelling to be located 25 feet
from the front property line, a variance of 5 feet(50 feet ) , (see
explanation in report text ) .
AREA CHARACTERISTICS
Applicant ' s property is located on lot number 9 in the Deer Run
subdivision. The subdivision is located off Route 743 in the
Earlysville area. This area is characterized by moderate residen-
tial strip development along Route 743. The topography of lot 9
is level . Homes built on this side of the street in Deer Run
average a 35 foot setback from the front property line.
ZONING HISTORY
Deer Run subdivision was approved on July 15, 1969 (see subdivision
plat ) . Lot sizes range from 1/2 to 3/4 acre.
AGENCY COMMENTS
The Health Department has reviewed the applicant ' s lot for septic
drainfield location . Mr. Rice with the Health Department states
that the lot is severely limited to a specific site and that a
minimum of 65 feet from the rear property line is required for
the installation of the drainfield (see attached letter) .
STAFF COMMENTS
Mr. Snow purchased lot number 9 with the understanding that he
could meet all setbacks required by the Zoning Ordinance. How-
ever, two issues became apparent that this was not the case.
First , the Health Department requirements severely limited the
location of the residence on the lot . Secondly, it was originally,
explained to Mr. Snow that since Deer Run subdivision was approved
prior to the Zoning Ordinance (December 22 , 1969) the setback
requirements must conform to the current ordinance. The Zoning
staff has since determined that the official date of adoption
of the first Zoning Ordinance is April 15, 1968. That ordinance
requires a 30 foot setback from the front property line versus
the 75 feet currently required. The 30 foot setback requirement
holds since this subdivision was approved on July 15, 1969 or
15 months after the April , 1968 official date of adoption. This
discrepancy resulted due to State litigation that occurred during
that interim and had direct impact on the adoption date of the
Zoning Ordinance.

It is the staff ' s opinion that a hardship exists in this case.
Mr. Snow bought the property in good faith with intentions of
meeting all zoning requirements. However, due to poor perco-
lation of the lot , severe limitations were placed on siting
the house. Also, this is not a hardship generally shared by
other properties in the adjacent area, nor would approval of
this variance cause substantial detriment to adjacent properties
or change the character of the zoning district .
STAFF RECOMMENDATION
Based upon the aforementioned, the staff recommends approval
of the requested variance.
STAFF NOTE: This case was advertised relative to the 75 foot
front setback required by the current ordinance rather than
the 30 foot setback required by the 1968 ordinance. I do not
feel that readvertisement is required because the salient
aspect of the case - to be setback 25 feet from the front
property - would remain the same in both advertisements.

Dear Sirs:
Please be advised that because of limited septic area and a number of
site conditions, the building site for Mr. Joel Snow, Lot 9, Deer Run Sub-
division, is severely limited to a specific site fairly close to the front
of the lot. A minimum of sixty-five (65') feet is required in the rear
of the home site for the installation of drainfield which leaves little
distance for setback on the house. The only area that can be used for
septic system is indicated on the septic tank permit.
