LOCATION: East side of Route 29 North approximately .3 mile
northeast of Carrsbrook Drive
VARIANCE REQUEST
The applicant requests a variance from Section 32 . 5 . 8 of the
Zoning Ordinance to allow a structure to be located 13 feet from
a service road, a variance of 7 feet. The applicant also requests
a variance from Section 21 . 7 . 2 to allow a structure to be located
46 feet from a residential district, a variance of 4 feet.
AREA CHARACTERISTICS
The applicant' s property is located on Route 29N adjacent to the
Real Estate III offices and opposite the Hilton hotel . The appli-
cant' s rear property line abuts Carrsbrook subdivision. The
property is generally level fronting along 29N but slopes up
radically along the rear property line.
This area presents a mix of commercial and residential uses.
ZONING HISTORY
The applicant has submitted a site plan which will be reviewed
by the Planning Commission this month. The service road concept
along this portion of Route 29N was approved by the Board of
Supervisors in late 1983 . This development fronts on that serv-
ice road.
COMPREHENSIVE PLAN
The applicant' s proposal conforms with the Comprehensive Plan.
AGENCY COMMENTS
All pub].i_r agency and departmental comments will be addressed
during the site plan review process.
STAFF COMMENTS
The applicant' s site plan shows a radically sloping bank to the
rear of the site. Three single-family residences exist on the
plateau of this bank in the Carrsbrook subdivision. The Planning
staff has stated their concern that development up to and upon
the toe of this slope may render the bank unstable. The appli-
cant' s site plan also indicates this concern by proposing a

retaining wall and chain link fence.
The applicant proposes a building that would cover 27 percent of
the site. Although the topography to the rear of the site some-
what restricts development, it does not restrict the site to the
extent that development could not occur other than what the ap-
plicant has proposed. In brief, if the size of the building was
reduced there would be no need to seek a variance.
STAFF RECOMMENDATION
Based upon the fact that the topography of this site does not
prohibit development; and that the strict application of the
Zoning Ordinance would not prohibit or unreasonably restrict
the use of the site, the staff is of the opinion that no hard-
ship exists and; therefore, recommends denial of the requested
variance.

Re: Variances Required for Floor Fashions Site Plan
As per our meeting on May 11, 1984, in reference to the above, I
have reviewed your site plan and you will need to seek a variance on the
following items prior to site plan approval.
VARIANCE REQUIRED FROM SECTION: 32.5.8. To allow part of the
structure to extend 13 feet (approximately) into the required
20 foot front setback from a service road.
21.7.2. To allow a part of the structure to extend four (4)
feet (approximately) into the required 50 foot separation
between commercial and residential districts.
I have attached an application for a variance that you will need to
fill out and submit prior to May 25, 1984, in order to be reviewed at the
Board of Zoning Appeals' meeting on June 12, 1984. Also, please be sure to
supply me with the topo of the rear of the site as we discussed on Friday.
