Chelton Dear Mr. Chelton: Re: Board of Zoning Appeals Action Concerning Variance, VA-84-57 I am writing to you as a reminder concerning the condirtion of approval for the church sign. The Board of Zoning Appeals approval was for a two (2) year limit . The sign must be removed from the property within thirty (30) days from the receipt of this letter. Should the church want to have the sign to remain on the property for a further time period, another variance application will be required to be filed, and then placed on the docket to be acted on by the Board of Zoning Appeals. Filing a new variance application would stay any action with regard to the removal of the sign as previously noted. STAFF REPORT - VA-84-57 APPLICANT: The American Lutheran Church (Peace Lutheran Church) TAX MAP/PARCEL: 32/42A ACREAGE : 2 . 882 ZONING: Rural Areas, RA LOCATION: West side of Route 20 North across from the entrance from Hollymead Development . VARIANCE REQUEST The applicant requests relief from Section 10.4 of the Albemarle County Zoning Ordinance to allow a location sign to be located 13 feet from the front property line, a variance of 62 feet . AREA CHARACTERISTICS The applicant ' s property is undeveloped as well as the adjoining north property. A single-family dwelling is located on the south abutting property. The entrance to Hollymead Development is on the east side of Route 29 directly across from the applicant ' s property. Starting at the front of the applicant 's property moving inward a severe slope exists of approximately 25 degrees or greater, extending more than 100 feet . No signs are located within the immediate area (West side) Route 29 North. COMPREHENSIVE PLAN The Urban Land Use Plan designates this area (West side of Route 29 North) for Industrial Use. On the east side of Route 29 - Commercial and Public/Semi Public use. STAFF COMMENTS The ordinance provides for 100 square feet of freestanding location signage, which is the same as business signs . The proposed sign shows the location and service times for the temporary church facilities , presently located in Hollymead. The sign would remain on this property until the permanent church site is developed on this same property. STAFF RECOMMENDATION The topography of the site at the 75 foot setback requirement would not afford adequate visual contact for the sign . The elevation of the property does not provide reasonable eye contact traveling on the road. The staff feels that a hardship would be imposed on the applicant to do so. We recommend approval subject to the following conditions : 1. Approval for a maximum of 2 years . 2 .
