This project is denied for reasons outlined, below. The application may be resubmitted for approval if all comment items are satisfactorily addressed. A. Stormwater Pollution Prevention Plan (SWPPP) (Rev. 1) Not addressed. SWPPP review comments persist, since revised SWPPP apparently not submitted. Please provide SWPPP. A .PDF is fine. The SWPPP content requirements can be found in County Code section 17-405. A SWPPP must contain (1) a PPP, (2) an ESCP, (3) a SWMP, and (4) any TMDL measures necessary. Stormwater Management Plan (SWMP) VSMP Regulation 9VAC25-870-108 requires the VSMP authority to approve or disapprove a SWMP. This plan is approved pending review of stormwater management calc. packet, and slight revisions —items 8.e., 10, 11 below. Applicability of other laws and regulations; time limits on applicability of approved design criteria. A. Nothing in this chapter shall be construed as limiting the applicability of other laws and regulations, including, but not limited to, the CWA, Virginia Stormwater Management Act, Virginia Erosion and Sediment Control Law, and the Chesapeake Bay Preservation Act, except as provided in § 62.1-44.15:27 K of the Code of Virginia, and all applicable regulations adopted in accordance with those laws, or the ri deral agencies, state agencies, or local governments to impose more stringent technical criteria or oth requirements as allo ed by law. B. Land -disturbing activities that obtain an initial state per it or commence land turbance prior to July 1, 2014, shall be conducted in accordance with the Part II C (9VAC25-970-93 et seq.) technical criteria of this chapter. Such projects shall remain subject to the Part II C technical criteria for two additional state permit cycles. After such time, portions of the project not under construction shall become subject to any new technical criteria adopted by the board. C. Land -disturbing activities that obtain an initial state permit on or after July 1, 2014, shall be conducted in accordance with the Part II B (9VAC25-870-62 et seq.) technical criteria of this chapter, except as provided for in gyAc2s-87o-48. Land - disturbing activities conducted in accordance with the Part II B technical criteria shall remain subject to the Part II B technical criteria for two additional state permit cycles. After such time, portions of the project not under construction shall become subject to any new technical criteria adopted by the board. c. Review and revise SWM Narrative and design, as needed to meet stormwater quality requirements listed at 9VAC25-870-65, and stormwater quantity standards listed at 9VAC25-870-66. (Rev. 1) Addressed. Since existing on -site bioretention basin is relied upon for the current application, plan must reflect As -built conditions consistent with VA DEQ Stormwater Design Specification No. 9, Level 1 or Level 2. Specify which bioretention design level this plan intends to meet. An existing BMP built to plan design (approved 7/12/13) that pre -dates the VSMP program effective date of 7/1/14 must meet applicable quality and quantity design requirements. Grandfathering (9VAC25-870-48) or Applicability of Part IIC (9VAC25-870-47) does not apply. This is not an Amendment application to an approved VSMP plan. VAR10C512 was terminated, July 2018. Storm runoff routes to an onsite bioretention basin, which then discharges to an intermittent stream, which eventually reaches a regional stormwater management basin below the site (though not immediately below). The VSMP permit application and all plans may be resubmitted for approval when all comments have been addressed. For re -submittal, please provide 2 copies of the permit package with a completed application form. Engineering plan review staff are available from 2-4 PM on Thursdays, should you require a meeting to discuss this review. Process After approval, VESCP plan will need to be bonded. The bonding process is begun by submitting a bond estimate request form and fee to the Department of Community Development. One of the plan reviewers will prepare estimates and check parcel and easement information based on the approved plans. The County's Management Analyst will prepare bond agreement forms, which will need to be completed by the owner and submitted along with cash, certificates or sureties for the amounts specified. The agreements will need to be approved and signed by the County Attorney and County Engineer. This may take 2-4 weeks to obtain all the correct signatures and forms. Stormwater Management Facilities Maintenance agreements may also weed to be eempleted and recorded. (Rev. 2) See Ex. SWM Facility Maintenance Agreement at bk.-pg. 4399-529. The County's Management Analyst or other staff will prepare the forms and check for ownership and signature information. The completed forms will need to be submitted along with court recording fees. Applicant will need to complete the request for apre-construction conference form, and pay the remainder of the application fee. The form identifies the contractor and responsible land disturbed, and the fee remaining to be paid. This will be checked by county staff, and upon approval, a pre - construction conference will be scheduled with the County inspector. At the pre -construction conference, should everything proceed satisfactorily, a grading permit will be issued by the County so that work maybegin.
