Now Noe STAFF REPORT - VA-84-59 APPLICANT: Riverbend Limited Partnership TAX MAP/PARCEL: 78/17D1 (part of) ACREAGE: 1.272 ZONING: C-1 5 LOCATION: „fit side of Route 250E located between Hardee ' s and First Virginia Bank VARIANCE REQUEST The applicant requests relief from Section 4. 15.3.6 of the Albemarle County Zoning Ordinance to allow a total aggregate area of freestand- ing signs of 100 square feet , a variance of 50 square feet . The applicant also requests relief from Section 21.7.1 of Zoning Ordinance to allow a freestanding sign to be located 15 feet from the public street right-of-way, a variance of 15 feet . AREA CHARACTERICS Alease/rental sign is now located on the strip of property zoned PD-SC, of the Hardee' s fast-food restaurant , and oo th of the First Virginia Bank. The applicant ' s 72 foot strip of property adjoins the First Virginia Bank's property. The proposed sign location would be on property that is slightly lower than the elevation of the roadway. Both the bank and the fast-food estab- lishment have freestanding business signs as do the businesses on the side of Route 250 East . COMPREHENSIVE PLAN All areas are designated in the Urban Land Use Plan for commercial use. STAFF COMMENTS The C-1 zone allows a maximum of 50 square feet freestanding signage and PD-SC allows 100 square feet . All properties with the exception of the 150 foot frontage piece in the strip from the Rivanna bridge to Riverbend Drive is zoned C-1. All properties have better than average visibility at the 30 foot setback area. STAFF RECOMMENDATION The Shopping Center development does not front on Route 250 except for an approximately 150 foot strip. The proposed sign would not be located directly in front of the business location like most other shopping centers. We find that this is the only uniqueness that provides for a minimal basis for a variance. We do not find that the 50 square feet additional signage is warranted given the adequate visibility and the existing business signage in the im- mediate area. The existing evergreen tree does not justify the need to position the sign closer than the 30 foot setback. At any closing, the usual prorations of taxes shall be made. When public sewer is available to serve the property purchased by the Purchaser, the Purchaser shall connect to such public sewer. 4. Seller is granted the right to have the property subdivided in accordance. with the attached sketch and upon receipt of subdivision approval, Purchaser will reconvey to Seller, or his assigns, without any consideration for such conveyance,__the 14,970 square foot tract as shown on the attached sketch, provided Riverbend Drive is accepted into the State Highway System or a shopping center-merchants association is formed consisting of merchants in a shopping center which may be developed by Seller•on adjacent land and-. It is understood that Seller, at his option, may elect not to put Riverbend Drive into the State Highway System, in which event Seller shall maintain Riverbend Drive to standards of maintenance and snow removal equal to those of the State Highway System. 6. Seller has not done any work on the property being purchased by Purchaser within the last 90 days. 7. Seller's attorney will see to the release of the deed of trust of record in Deed Book 598, at page 336 as corrected by instrument of record in Deed Book 613, at page 524. 8.
