STAFF REPORT - VA-84-66
APPLICANT: Fisher Auto Parts
TAX MAP/PARCEL: 61/120U
ACREAGE: . 867 acre
ZONING: HC (Highway Commercial )
LOCATION: Northwest side of Route 29 North, approximately
300 feet south of its intersection with Rio Road
VARIANCE REQUEST
The applicant requests relief from Section 4. 15. 3.7 of the Albemarle
County Zoning Ordinance to allow existing freestanding signage of
188 square feet aggregate area, a variance of 88 square feet .
AREA CHARACTERISTICS
The sign location is at the site housing Bojangle ' s - fast food
operation - located on the south bound lane of Route 29 North.
Amodest up-hill grade from the road to the sign location exist .
To the north of the property is located Hardee ' s - fast food
restaurant . South of the property is Desserts and More - an in-
dependent Deli and Pastry establishment .
The Fisher Auto Parts (former Coiner Parts) is located to rear of
the Bojangle ' s business place.
COMPREHENSIVE PLAN
The Urban Land Use Plan has all of the immediate area designated
commercial .
STAFF COMMENTS
The Ordinance allows for two (2) freestanding signs to be located
on one premise or lot , but all signs shall not total more than
100 square foot of aggregate area as per Section 4. 15. 3. 7.
Coiner Parts (presently Fisher Parts) erected a sign years past -
as an off-site or location sign. Bojangle ' s developed their site
and erected their business sign, along with the Fisher sign. The
Bojangle ' s sign was approved for their present location, but at
the same time the Fisher sign was not considered in reference to the
location.
Since the Fisher sign has been located on the site for some time,
some consideration is warranted.
STAFF RECOMMENDATION
The Fisher sign has been located on the site prior to its develop-
ment . A second sign (Bojangle ' s) has been erected since. Because
of an oversight , it is some what unique in that Fisher ' s business
sign is not on their site, and they do not have a freestanding sign

as such at their business location. The staff recommends approval
subject to the condition.
1. Fisher Auto Parts will not be allowed any additional
freestanding signage or the occupant of parcel Tax Map
61, Parcel 120W.

near the intersection of U. S. Route 29 and Rio Road, on which is
located a Bojangles ' Restaurant. Your firm operates a business on
adjacent property to the rear of the Bojangles ' site.
We have been notified by Albemarle County that the sign
ordinance has been violated because the two signs , the one for
Bojangles and the one for Fisher Auto Parts exceed 100 square feet.
We enclose a copy of the letter of the Zoning Inspector dated May
2 , 1984.
Please have the Fisher sign removed within the thirty (30) day
period set forth in the letter. If you wish to apply for a
variance, we will be glad to cooperate in any reasonable way.
