Wood, Owner) TAX MAP/PARCEL: 79/9 ACREAGE: 1. 18 ZONING: C-1 (Commercial) LOCATION: At the intersection of Rt . 22 and Rt . 250 east VARIANCE REQUESTED The applicant requests relief from Section 21.7. 1 of the Albemarle County Zoning Ordinance to allow an enclosed addition to be added to the existing store front making the structure 23 feet from the right-of-way, a variance of 7 feet . AREA CHARACTERISTICS The applicant ' s property is zoned C-1, Commercial, and has an exist- ing convience/country store with accessory gas pumps. Properties adjoining to the rear are commercially zoned, but one is vacant , and the other is used for residential purposes. On the south side of route 250 east is property zoned NR (Natural Resource) which is owned and operated by Luck Quarries. On the north side of route 22 is agricultural property zoned RA (Rural Areas) . The addition added to the front of the structure extends toward the existing gas pump island and the connecting road between route 250 and route 22. All areas around the store are paved and provides access and parking for the store patrons. The property is served by private water and septic system. COMPREHENSIVE PLAN Land in the vicinity of the interstate exchanges should be developed in a manner consistent with the area in which it is located. Two (2) categories are recommended for (Rt . 250 east Shadwell) , regional uses, and Highway Service businesses (in brief) . AGENCY COMMENTS No near future plans are anticipated for the connection point (appli- cant ' s property) route 250 east and route 22 by the Highway Department . STAFF COMMENTS The existing structure is located just about 30 feet from the connect- ing road right-of-way from route 250 east to route 22. A small 6 foot+ wide nonsupporting type roof existed above the entry door was removed prior to the construction of the addition. STAFF REPORT - VA-84-77 Page 2 The construction on the addition was started, and is at present under roof, prior to the application being made for the variance . As shown on the building plans, the additions design purpose seems to provide an enclosed air space for both hot and cold weather conditions. The addition has an entry door at each end of the structure . Any addition added to the buiding would have to be the north side or toward Route 22 to meet the required 30 foot setback. An addition to the front is a convenient action on the applicant ' s part , but a new or another entry would have to be established on the north side to meet the setback requirement . There is a finding of no hardship, but one of making a situation safer, and or more convenient for patrons to enter the establishment . STAFF RECOMMENDATION Based solely on the factors for granting a variance we cannot find a hardship. If the Board so wishes to grant the variance that it be with the following recommendation. The use of the addition will be solely for safer and a weather re- lated purposes, and not to provide additional sales area, and for ad- vertising.
