LOCATION: On the north side of Route 692 directly in
front of its intersection of Route 635
VARIANCE REQUEST
The applicant requests relief from Section 4.6.3 .2 to allow
expansion of existing post office to within approximately 4 feet
from easement , a variance of 56 feet ; also requests relief from
Section 10.4 to allow expansion 15 feet from right-of-way of
Route 692 , a variance of 60 feet . Also, requests relief from
Section 6. 4. 1 for non-conformities expansion and enlargement .
AREA CHARACTERISTICS
Located on the applicant ' s property of . 47 acres is a rural country
store with the Post Office facilities housed in the same structure .
The store is located on Route 692 directly in front of its inter-
section with State Route 635. Highway Route 692 abuts the front
property line at which point is located the gas pumps and covered
porch area with steps which lead into the store entrance.
On the other side of the easement is located a small parking area
for customers both of the store and post office.
Residences are located on properties to the east , west , to the rear
served by the easement , and also across Route 692 partly in front
of the store.
COMPREHENSIVE PLAN
The Urban Land Use designates this area as Open Space or a maximum
density of one dwelling per two (2) acres.
AGENCY COMMENTS
Route 692 has a 40 foot right-of-way until it reaches the inter-
section of Route 635 at the property store front . The right-of-
way of Route 692 SE. to the other Route 635 intersection is 30
feet .
STAFF COMMENTS
The applicant ' s proposed expansion of the Post Office facilities
would encroach on the easement by approximately 6. 5 feet further
than the existing structure. Almost no other expansion of the
structure is physically possible at the proposed addition loca-

tion because of the topography of the easement . For possible ex-
pansion there is a very limited area suitable in respect to the
topography at the rear of the existing structure.
Expansion of the existing structure will line up with the present
setback from Route 692. As shown on the proposed construction
plan, entry to the Post Office will be created fronting onto Route
692. Area in front of the existing structure is paved and is fre-
quently used for customer parking. The applicant is restricted
from expansion onto the front of the building because of its lo-
cation in respect to the road. The staff has concern with the
establishment of the entry at its proposed location due to that
area being used for parking. The staff is of the opinion that
the applicant has a hardship and is restricted with a very limited
area for any type of expansion.
STAFF RECOMMENDATION
The staff recommends approval of the variance subject to provisions
being made to prohibit parking in the immediate area of the entry
to the proposed addition, and that if not required by the BOCA
code regulations - some type of protective devices such as guard
rails to protect the entrance of the proposed addition.

THIS DEED, made this 21st day of June, 1963, by and
between VIRGINIA PAGE MACKEY, a widow, MARY A. PAGE
AREHART, a widow, GORDON H. PAGE, divorced, hereinafter

called "Grantors", and CHARLES 0. PAGE, JR., hereinafter
called "Grantee",
WITNESSETH:
THAT WHEREAS, Charles T. Page died intestate in
1939 seised and possessed of the lands hereinafter described and
conveyed, leaving his widow, Mary A. B. Page, and Gordon H.
Page, Virginia Page Mackey, Charles T. Page, Jr., and Mary A.
Page (now Mary A. Page Arehart), his children, as his sole sur-
viving heirs at law;
AND WHEREAS, the said Mary A. B. Page, the widow
of Charles T. Page, has sinced died;
AND WHEREAS, the Grantors, owners of a three-
fourths undivided interest in the said lands, have agreed to sell
their interest therein to the Grantee;
NOW THEREFORE THIS DEED FURTHER WITNESSETH,
that for and in consideration of ten dollars ($10.00)cash and other
valuable considerations paid by the Grantee to the Grantors,
receipt of which is hereby acknowledged, the said Grantors hereby
GRANT, BARGAIN, SELL and CONVEY with GENERAL WARRANTY
OF TITLE unto the Grantee their three-fourths undivided interest in

that certain lot or parcel of land situated in the village of Batesville
in Albemarle County, Virginia, which is shown and designated as
Lot 1 on a plat of survey made by O. R. Randolph, Engineer, dated
6/12/63, a copy of which is attached hereto as a part of this deed.
Said Lot 1 contains .47 of an acre, more or less, and is bounded
and described as follows:
Beginning at an iron in the center of
State Route 692, thence N 45° 21' W
205.20 feet with the center line of
State Route 692 to an iron, thence
N 45° 37' E 147 feet to an iron, a
corner with Elmer G. Batten, thence
S 38° 18' E 17.87 feet to an iron in
the center of the Old County Road,
thence S 13°42' W 3.71 feet, thence
S 0°29' E 73.14 feet, thence S 45° 21'
E 123.92 feet to an iron, a corner with
Everett Nay, thence S 40°0' W 70.30
feet to an iron and continuing on the
same course 20 feet to the point of
beginning.
The lot hereby conveyed is a portion of the lands which
were conveyed to the late Charles T. Page by deed of C. S. Joseph
and wife dated May 1, 1914, and recorded in the Clerk's Office of
the Circuit Court of Albemarle County in D. B. 156, p. 21.
Reference is here made to said plat and deed for a more particular
description of the lot hereby conveyed.
This conveyance is subject, however, to the rights of the
public and of other adjoining property owners to use the Old County
Road as it crosses the lot hereby conveyed as shown on the attached
plat. The Grantors hereby specifically reserve unto themselves,
their successors and assigns, the perpetual easement to use said
road for purposes of ingress and egress to and from their adjoining
property.

Subject to the matters mentioned above, the Grantors
hereby covenant that they are seised of their respective interests
in the lot hereby conveyed in fee simple and have a perfect right
to convey the same; that they have done no act to encumber the
same; that the Grantee shall have quiet possession of said interests,
free from encumbrances; and that they, the said Grantors, will
execute such further assurances of said interests as may be
requisite.
