AREA CHARACTERISTICS The applicant ' s property is located in the Berkeley subdivision which is a nonconforming subdivision that predates the Zoning Or- dinance. Many homes in the immediate area front on Williamsburg Road closer than the required 25 feet . A portion of the applicant ' s lot fronts on a paved temporary cul-de-sac. It is very unlikely that Williamsburg Road will be extended in the future due to topo- graphic concerns. STAFF COMMENTS As previously stated, this subdivision predates the Zoning Ordi- nance. However, Section 6. 5 states (in paraphrase) that although the subdivision is nonconforming it must still meet the setback requirements of the current Zoning Ordinance for that zoning dis- trict . In all fairness to the applicant , this variance request is the result of misunderstood information between both the applicant and the Zoning Department . Subsequently, the setback was incorrectly measured and the foundation for the addition was poured. The lot that the applicant owns is relatively small. The use of the lot is further restricted due to the setback distance that must be taken from the right-of-way line of the temporary cul-de- sac. Based upon the size and shape of the lot and consideration of further restriction by the temporary cul-de-sac, it is staff ' s opinion that a hardship would exist if the strict interpretation of the Zoning Ordinance was enforced.
