VARIANCE REQUEST
The applicant requests relief from Section 10. 4 of the Albemarle
County Zoning Ordinance to allow an existing single-family dwelling.
to be located 19 feet from the side property line, a variance of
6 feet .
AREA CHARACTERISTICS
The property is located in a rural area just north of the Broadus
Wood Elementary School. There are other single-family residences
located north and south of the applicant ' s property. Most of the
adjoining properties are of the 2 acre caliber also, which are
served by private well and septic systems. The house is located
16 feet from the south property line (side) .
COMPREHENSIVE PLAN
This area is designated OPEN AREA under the LAND USE PLAN which
allows a minimum density of two (2) acres per dwelling unit .
STAFF COMMENTS
When the building permit application was made, a copy of the plat
was submitted showing the proposed location of the house meeting
the required setbacks. About a month after the building permit
application was made, the applicant called for a footing inspection.
The inspection was rejected when made because the side setback
was in violation.
Two alternatives were discussed at that time. One, that of relo-
cating the house at the proper setback requirement . Two, changing
the property line so that the house would not be in violation. A
survey was done, showing the changed property line. The plat was
approved by the Planning Department , but it was not recorded
because an agreement was not reached with the adjoining property
owner.
The house is completed and is located 19 feet from the side prop-
erty line.

Based on the foregoing information, the staff recommends approval
solely on the basis of corrective circumstances.

1984 by and between DAVID L. MARSHALL and SALLY F. MARSHALL,
husband ,and wife, hereinafter referred to as the Grantors, and
FERRELL L. MERCER and DEBORAH M. MERCER, husband and wife,

of which is hereby acknowledged, the Grantors do GRANT, BARGAIN,
SELL AND CONVEY, with GENERAL WARRANTY and ENGLI$H COVENANTS OF
TITLE unto Ferrell L. Mercer and Deborah M. Mercer, husband and
wife, as tenants by the entirety with full rights of survivor-
ship as at common law, and not as tenants in common, all that
certain tract or parcel of land with all improvements thereon,
located near Earlysville in the Rivanna Magisterial District of
Albemarle County, Virginia, on State Route 663, containing 2
acres, and known as Parcel 20L, Sheet 19, on Albemarle County
Tax Map, as shown on physical survey of B. Aubrey Huffman &
Associates dated October 1, 1984 which is attached hereto and
made a part of this deed; and being the same property in all
respects as was conveyed to David L. Marshall and Sally F.
Marshall by deed of Carlton E. Wood and Joyce R. Wood, husband
and wife, dated June 6, 1978 and recorded in the Clerk's Office
of the Circuit Court of Albemarle County, Virginia, in Deed
Book 650, page 93.
This conveyance is made expressly subject to the easements,
conditions, restrictions and reservations contained in duly
recorded deeds, plats, and other instruments constituting
constructive notice in the chain of title to the property hereby
conveyed, which have not expired by a limitation of time
contained therein or have not otherwise become ineffective.
