Bentley TAX MAP/PARCEL: 61W(2)/02-J5 ACREAGE: 1540 Saquare Feet ZONING: R-6, Residential LOCATION: Minor Ridge Court (Minor Hill Subdivision) VARIANCE REQUEST The applicant requests relief from Section 4.11.2.1 of the Albemarle County Zoning Ordinance to allow a storage building to be located 6" from the side property line, a variance of 5'6" , and also to allow this storage building to be located 5' from the rear property line, a variance of 1 foot . AREA CHARACTERISTICS Minor Hill Subdivision consists of attached townhouses where the applicants' properties are located. There are four (4) basic size lots in the development . Interior lots have dimensions of 22 feet x 65 feet and 22 feet x 75 feet . End lots measure 41 feet x 65 feet and 41 . 75 feet x 75 feet respectively. Townhouse units are in groups of 6 in each block section. The shorter units of the 22 foot range are located on the 75 foot lots. Front setbacks vary a couple feet on the units, to break the uniform pattern on straight line construction. Most all lots in the subdivision development are of level topogra- phy. There are easements for utilities, and recreation access that have to be spoken to later on. COMPREHENSIVE PLAN The Urban Land Use Plan designates the immediate area for High Denisty Development (11-34 units per acre) AGENCY COMMENTS Any proposed building located less than 6 feet from a property line is subject to building/fire code regulations and further specific information, and permit may be obtained through the County Inspections Department . No structure may be so located on a utility easement , unless written approval can be obtained through the appropriate agencies (Service Authority, Gas Company, Telephone Company or etc. ) . vrr STAFF REPORT - VA-84-80 Page 2 STAFF COMMENTS In reviewing the proposed variances we found common conditions among all variances. One factor, is basically the same size lot, on all but VA-85-31. The usual factors that support the recommendation for granting a variance are hard to define for all such cases. We find that the applicants are restricted in the use of the property by the area involved 22 ' x 22' less the required setback 6' and 6 ' , leaving 228± square feet . Variance, VA-85-31, has a 41 foot lot (in width) or 902 square feet less 6 ' and 6 ' , leaving 560 square feet . All facts pertaining to any applications should be presented to the Board. Republic Homes is responsible for the location of all , but two of the storage buildings located in the subdivision at the time of the Bentley' s application. Notices were supposedly sent to the homeowners by Republic Homes giving information about meeting required locations and obtaining permits. Building permits were obtained, but not until the buildings had already been located on the properties. STAFF RECOMMENDATION Based on the foregoing we recommend the following: A) Any approved variance is subject to the BOCA building/ fire code regulations. B) Any variance approved pertaining to or regarding a utility easement be subject to written approval from any appropriate agency. Staff recommends approval of the requested variance. STAFF REPORT - VA-84-80 APPLICANT: William F. Bentley TAX MAP/PARCEL: 61W2 , Parcel 02-J5 ACREAGE: 1540 square feet ZONING: R-6 , Residential LOCATION: 1533 Minor Ridge Court VARIANCE REQUEST The applicant requests relief from Section 4. 11.2. 1 of the Albemarle County Zoning Ordinance to allow a storage building to be located 6" from the side property line, a variance of 5'6" , and also to allow this storage building to be located 5 ' from the rear property line, a variance of 1 foot . The proposed shed is to be placed on the 22 foot by 65 foot lot , which is the size of all the interior lots within the subdivision. The end units are located on lots of approximately 40 feet in width. Most all of the subdivision lots are of level topography providing suitable building locations. Lots in the J-Block section have an easement located along the rear property line. COMPREHENSIVE PLAN The Land Use Plan designates the immediate area for High Density Development (11-34 units per acre) . AGENCY COMMENTS Any proposed building located less than 6 feet from a property line is subject to building/fire code regulations. STAFF COMMENTS The applicant ' s lot is not any smaller in dimensions than the other interior lots of the development . There is no topographical or physical characteristics of the property that would hamper the location of the proposed structure. Accessory structures have been located on comparable lots to meet the required setbacks. The staff finds no undue hardship, or that the applicant is re- stricted in the use of the property. Those requirements are, that storage sheds be properly anchored and that the placement of the storage sheds meet the property setbacks as outlined by the County of Albemarle Departments of Inspections and Zoning. I am contused about what it is you' re as,c�ng me. As I understand the situation, a decision on my application for variance was deferred by the Board of Zoning Appeals, because they wished to reach a judgement on my case and the seven other sheds together. (Your letter refers to only five other sheds; there are seven other sheds in the townnouse area placed iileyal- ly) . I was told at the hearing to wait to near from the appeals board. I presumed there would be another hearing when Republic Homes and any other individuals who had built or bought their own sheds would bring their appeals to the Board, and I would recieve notification of when that hearing would be. If you are asking me if I wish to withdraw my application for variance, I do not. My position is that to require a 6 ' setback in a yard only 2Ux22 feet to begin with denies reasonable use of the property, as the shed would have to be positioned square in the center of an already miniscule yard. If the building code require- ments are enforced, which require a 1 hour fire wail along any side of a structure closer to a property line than o ' , and that the structure be tied down with footers or steel cable, the place- ment of sheds along property lines poses no increased safety risks. My understanding , therefore, is that I should continue to wait to hear from the appeals board about another hearing. If this is incorrect, please contact me and inform me how I should proceed. The storage building is located in violation of the required setbacks of the County Zoning Ordinance (Section 4 . 11 .2 . 1 , copy enclosed) . One alternative to correct the problem is to relocate the building to meet the required setbacks. The other solution is to proceed with filing a variance application. A frame, combustible, structure con- structed less than six (6 ) feet requires a one (1 ) hour fire separation wall for the wall facing the property line . This is the requirement of the Virginia Uniform Statewide Building Code (1981 BOCA - Table 401) .
