VARIANCE REQUEST The applicant requests a variance from Section 10.4 of the Ordinance to allow a parcel to be subdivided with 164.75 feet of road frontage, a variance of 85.25 feet . AREA CHARACTERISTICS The applicant ' s property is located in a rural portion of the County. This area is characterized by sparse residential development along Route 708. COMPREHENSIVE PLAN The Plan designates this area as Open Space which translates into a maximum density of one dwelling unit per two (2 ) acres. STAFF COMMENTS The applicant proposes to subdivide two acres from a larger tract consisting of 46+ acres to convey to a family member. Two dwelling units currently exist on the property approximately 90 feet from each other. The applicant is seeking a variance because the dis- tance between the dwelling units will not allow him to subdivide with the required 250 feet of road frontage. It is staff ' s under- standing that the dwelling units have been on the property since prior to the Zoning Ordinance. Staff is unable to identify a clearly demonstrable hardship in this case, therefore, the burden of proof belongs to the applicant . However, in all fairness to the applicant , staff notes that this request, if granted, would not damage the intent of the Ordinance nor would it create a negative impact on adjacent property owners. Instead of re- questing a variance, we suggest that you eliminate all but one entrance to the properties on Route 708. If both properties enter Route 708 off of a private road, then each lot does not need the 250 foot state road frontage. If you have a total of two parcels in this subdivision, the planning staff can approve this division administratively, and it will not have to be heard before the Planning Commission. If you create more than one additional parcel, your request for a subdivision must be reviewed by the Planning Commission. When and if you decide to subdivide, please have your surveyor contact the planning staff. I regret if my previous letter has caused you any inconvenience. I explained t._at they need to submit a si—tch to our office showing how they want to subdivide the property and it needs to be accurate to make sure they request the correct amount so would need to have a surveyor or engineer do it . She said that the inspector could start from the survey peg of the adjacent property (Coffee) which was done four or so years ago. She said the only problem was with the ranch house. She said that Lincoln did the survey for Coffee.
