Whelan Land Surveyor SCALE : 1" : 60' MARCH II , 19 85 CharlotteeviII•, Virginia 1 voii STAFF REPORT - VA-85-4 APPLICANT: Daniel Bieker TAX MAP/PARCEL: 30-27T ACREAGE: 2 . 0 acres ZONING: RA (Rural Areas) LOCATION: West side of Rt . 660, approximately 1 mile north of its intersection with Rt . 662 in Blue Ridge Forest Subdivision located adjacent to Fairgrove VARIANCE REQUEST The applicant requests relief from Section 10.4 of the Albemarle County Zoning Ordinance to allow a dwelling to be located 50 feet from the private right-of-way; a variance of 25 feet . AREA CHARACTERISTICS The Bieker lot is located in a seven (7) lot subdivision located off Route 660. Lot B is the only vacant lot , other than the Bieker property. Both Lot F and the Bieker lot consist of slopes in the 15 to 25 degree range. The Bieker property is relatively level at the house location after some grading has been done. To the rear of the proposed house location the property slopes downward toward the drainage easement . The house location is above road level with the exception of the driveway entrance. COMPREHENSIVE PLAN The Urban Land Use Plan designates this area for open space on a minimum density of two (2 ) acres. AGENCY COMMENTS The septic tank will be located at the left rear corner of the house, and the drainfield lines will run parallel with the house along the rear slope of the property. The septic field must be located an adequate distance from the drainage area to prevent contamination of that area. STAFF COMMENTS It is very questionable whether or not a house could be located on the lot at the required setback. The house design (an L shape) , presents a situation dealing with the topography at the required setback. To be practical, and not have the rear of the house either a number of feet above grade, or to add substantial fill dirt , the most accommodative location would be relevant to the Biekers proposed location. The staff finds that the lot presents both a topographic and a health hard- ship for the most reasonable location of the residence.
