Bice TAX MAP/PARCEL: 62/29B ACREAGE: 2.00 acres ZONING: RA (Rural Areas) LOCATION: On Route 769 - 1. 2 miles from Route 20 North VARIANCE REQUEST The applicant requests relief from Section 10.4 of the Albemarle County Zoning Ordinance to allow an addition to single-family dwelling to be located 57 feet from the front property line , a variance of 18 feet . AREA CHARACTERISTICS The Bice's property is located at the end of Route 769, where the state maintenance stops. There are two (2) residences adjoining the Bice property, one to the north and the other to the south. Open field area provides a view to the west , and hilly terrain is located to the east at the rear of the residence . There is limited level open space to the rear of the house . The septic system is located at the north end of the house. COMPREHENSIVE PLAN The area designated on the Urban Land Use Plan is OPEN SPACE- which has a minimum density of two (2) acres per dwelling unit . STAFF COMMENTS When the subdivision plat was approved in 1977, a 25 foot strip across the front of the property was dedicated for future road use. The existing house was constructed in 1977, at which time the setback was checked and the additional 10 foot dedication was not taken into consideration, therefore , the existing house is located 66 feet from the front property line. An addition is proposed to the front living area of 4 feet , a 12 ' x 28 ' dining, family room on the south end, and a new deck on the front for entry. In review of the proposed additions, the applicant is restricted for any addition to the north end of the house because of the system location. An addition to the rear of the house is limit- ed due to the physical floor plan of the structure , the modular construction, and the depth of the rear lot area. STAFF REPORT - VA-85-05 Page 2 When the house was originally located, it was not set at the proper setback. Even if the house had been setback properly, any future addition would require a variance as asked for under this application. STAFF RECOMMENDATION Based on the criteria for granting a variance, the staff cannot pinpoint a specific hardship and recommends denial . Some comments to the Board are the following: The property is located on a dead end road - which eliminates through or increased traffic. Route 769 is a secondary or unpaved road unlikely to receive little or any major improvements because of the foregoing. In our opinion the variance for the proposed ad- dition would not change the character of the area, or have any detrimental effect on the adjoining properties.
