. 3 mile east of its intersection with Route 29

VARIANCE REQUEST
The applicant requests relief from Section 17. 3 of the Albemarle
County Zoning Ordinance to allow a freestanding sign to be lo-
cated 5 feet from a right-of-way, a variance of 20 feet . Also,
requests relief from Section 4.15. 3.5 to allow a freestanding
identification sign not to exceed 20 square feet , a variance of
18 square feet .
AREA CHARACTERISTICS
The applicant ' s property is bordered by a residence on the west
side and vacant land on the east . Not actually bordering to the
rear is the school. On the opposite side of Rio Road is undevel-
oped land. The applicant has taken a single-family residence and
converted it to a Real Estate office, plus added a 1,200 square
foot addition to the rear of the existing structure.
The applicant ' s property line is located 105+ feet from the existing
pavement , which is 10 foot grade level higher than the road level .
Beyond the property line 20 feet is the parking area and further
is the building at 70 feet . Open space exists from the existing
road back to the property line.
ZONING HISTORY
The applicant had a Special Use Permit , SP-84-23 , approved by the
Board of Supervisors in June, 1984 to locate a professional office
on this property. A site plan was also approved showing the exist-
ing building and addition including the new entrance, parking and
etc.
The applicant has an application pending for rezoning (ZMA-84-22)
the property from R-10 (Residential) to CO (Commercial Office) .
COMPREHENSIVE PLAN
The Urban Land Use plan indicates this area for Medium and Low
Density Residential.

AGENCY COMMENTS
At present the right-of-way of Route 631 (Rio Road) is 90 feet .
The Highway Department plans for future expansion of the right-
of-way.
STAFF COMMENTS
Most development is usually adjacent to or fairly close to the road
right-of-way rather than at 100 feet as this case is.
Second, reviewing the property as residential with a Special Use
Permit or aspotential CO (Commercial Office) is considerably
different .
Residential zoning allows a very limited signage, verses 50 square
feet freestanding signs permitted under CO (Commercial Office) .
An evaluation of either requirements of the residential or commercial
office zoning warrants some hardship because of the considerable
highway right-of-way width that presently exists.
For a sign to be readily visible from the road it appears to be
necessary to locate it toward the property line. The elevation of
the property at the point where it joins the road right-of-way is
approximately 10 feet greater. The combination of the grade eleva-
tion and the great distance from the present road does present grounds
for hardship.
STAFF RECOMMENDATION
The staff recommends approval of the variance subject to the limita-
tion of the size sign as submitted with the application.
