ACREAGE: 71.704 & 7 acres (78 .704 acres total)
ZONING: Rural Areas (RA)
LOCATION: Southwest side of Route 708 approximately . 3 mile
southeast of its intersection with Route 29 South
VARIANCE REQUEST
The applicant requests a variance from Section 10.4 (Minimum setback/
yard requirements) to allow:
1. A single-family dwelling to be located 30 feet
from the front property line, a variance of 45
feet (Parcel 8) .
2 . A single-family dwelling to be located 35 feet
from the front property line, a variance of 40
feet (Parcel 8) .
3. A duplex to be located 50 feet from the front
property line, a variance of 25 feet (Parcel 9) .
(Please see attached sketch. Numbers above correlate to sketch) .
AREA CHARACTERISTICS
This area is characterized by large farms and sparse single-family
development .
The Hardware River runs along the south side of Route 708. The
terrain along the north side of Route 708 is steep and generally
undevelopable without extensive grading, and sedimentation, and
erosion control measures.
STAFF COMMENTS
Two parcels of property - parcel 8 and 9 - are involved in this
variance request . The two single-family dwellings are proposed
for parcel 8. Approximately 75% of the acreage of parcel 8 is
designated as flood plain along the Hardware River. This acreage
may not be developed for human habitation. The majority of the
remaining acreage exists as farmland.
The buildable area on parcel 9 is restricted by steep slopes on
the north side of Route 708 and flood plain to the south.
The staff is of the opinion that a demonstrable hardship exists
based on the restricted buildable area on both lots due to the
flood plain delineation and severe topographic conditions (parcel
9) .

RECOMMENDATION
Staff recommends approval of the requested variance based upon
the above comments and Section 34.2 of the Zoning Ordinance.

The lot sizes are such that t ere appears to be enou&h area to install the
required amount of drainfield 'for an average size building, plus an alternate
drainfield within the building site. If this property is in the Run-Off Control
area, then it will comply to all standart-16 of the Run-Of_f Control Ordinance.
However, each lot will be evaluated on its own merit, and further tests
may be required at the time the septic permit is applied for. Issuance or denial
of the permit �;4n hat based on the results of these tests.
