If so, state substance of decisi:.n: Date of Hearing: -J _cl j Final Decision Made: /9 r9 The variance sought was /approved with the following conditions / /¢ l-' p all T�- __.- u o end ki 7;Kki Special Use Permit# BOARD OF APR 'S Sign Permit# Building Pe_rni t# STAFF REPORT - VA-85-13 APPLICANT: Oak Ridge Baptist Church TAX MAP/PARCEL: 126/21A ACREAGE: 1.01 ZONING: RA (Rural Areas) LOCATION: Northwest side of Route 721 , ± . 7 mile north of its intersection with Route 6 VARIANCE REQUEST The applicant requests relief from Section 10.4 of the Albemarle County Zoning Ordinance to allow an addition of bathrooms to the front of the church to be located 23 feet from the road right-of- way, a variance of 52 feet . AREA CHARACTERISTICS The existing church is located on the west side of Route 721 just north of Route 6. Several 100 yards to the south of the church are two (2) mobile home residences. Across from the church on property owned by Carr is several abandoned quarries. Just north of the church about 400 yards is another church (Centenary Method- ist ) . Property surrounding the church site on the west side of Route 721 is undeveloped and owned by Industrial Development Au- thority of Nelson County. Part of the church property lies on the east side of Route 721, which is unused or undeveloped. The fellowship hall and the church are located on the west side of Route 721. You enter the property through the parking area, and circle around the church back to the parking area or to Route 721 by the fellow- ship hall . Approximately 30 feet from Route 721 is the present church building. The proposed addition to the front will further encroach on the setback. A septic system will be installed on the south side of the church building to serve the bathrooms addition. COMPREHENSIVE PLAN The Urban Land Use Plan designates this area as Open Space on a maximum of two (2) acres per dwelling unit . STAFF COMMENTS An addition could be added to either end of the building in regard to minimal structural change, whereas a side add on would be more involved and costly. The most prevalent factor that had to be dealt with was the soap- stone croppings which are located in several areas on the property. This general area being adjacent to a quarry is prevalent with evidence of the soapstone resource. STAFF REPORT - VA-85-13 Page 2 The topography of the property slopes downward on the south side of the church. Locating a suitable septic and drainfield area is more probable and is proposed in this area. STAFF RECOMMENDATIONS Based on the following we recommend the variance to be approved. A) Limited lot area, in conjunction with suitable area for septic and drainage area. B) Unique situation, whereas you have an existing use that does not have an existing sewage system. A health provision that benefits that use of the building, and protects adjacent properties. Therefore, you would need to apply for a variance before you can proceed with your building permit #85-277AI . Please find en- closed a copy of a variance application which needs to be completed and signed by an authorized agent for the church, such as a trustee. Also, there is a $20 application fee, and checks should be made payable to the County of Albemarle.
