ACREAGE: 2.097 acres
LOCATION: On Route 664, ± 300 feet southwest of intersection
of Route 810 & Route 663, near Nortonsville,
Albemarle County, VA
VARIANCE REQUEST
The applicant requests relief from Section 10.4 of the Albemarle
County Zoning Ordinance to allow an existing single-family dwelling
to be located 23 .80 feet from the front property line, a variance
of 51.20 feet .
AREA CHARACTERISTICS
There are several residences including a mobile home located in
the immediate area of the applicant ' s property. Adjoining the
proposed two (2) acre tract is a nonconforming used car business.
On the west side of Route 664 is the remaining fourteen (14) acres
of parcel 33B, which is undeveloped.
The proposed two (2) acre tract has an existing residence located
twenty-three (23) feet from the front property line on road right-
of-way.
COMPREHENSIVE PLAN
This area is designated Open Space on the Urban Land Use Plan or
a maximum density of two (2) acres per dwelling unit .
STAFF COMMENTS
The existing house on the proposed two (2) acre tract is required
to obtain a variance because of its setback from the front property
line upon requesting division of the two (2) acre parcel from the
sixteen (16) acre tract .
A physical separation already exists, being that the proposed two
(2) acre portion is on the west side of Route 664, and the remaining
fourteen (14) acres lies on the east side. Requirements such as
road frontage, area, and future road dedication can be met for
subdivision approval .
With no previous knowledge or history of the property, it appears
from the county tax maps and the plat submitted that a road existed
at one time connecting to Route 810 (referred to as old road) .
We feel that unique or unusual circumstances are involved with the
property, and not shared by others in the general vicinity.

STAFF RECOMMENDATION
The staff is of the opinion that the creation of the two (2) acre
lot serves the intent of the provisions of the ordinance and would
not be of any detriment to character of the neighborhood. We re-
commend approval of the variance subject to no future addition be
added to the front of the residence to further encroach on the front
setback.

This letter is to confirm that prior to plat approval, the above referenced
plat (which designates a new parcel and a 25' strip to be dedicated to public
use) , would require a variance from Section 10.4 of the Albemarle County
Zoning Ordinance.
I am enclosing a copy of Section 10.4 for your review. As stated, in the.
RA (rural areas) zone, any structure would be required to be at least 75'
from any public street right-of-way.
The next deadline for filing a variance application is March 22, 1985, with
a meeting to be held on April 9, 1985.
