Yancey(Curtis Heating & Plumbing) TAX MAP/PARCEL: 55B/16 ACREAGE: . 576 ZONING: HC LOCATION: South side of Rt . 250 west, approximately . 3 mile east of its intersection with Route 797 VARIANCE REQUEST The applicant requests a variance from Section 30. 5. 6.2 . 1 of the Zoning Ordinance to allow a storage shed to be located 49 feet from the right- of-way of a scenic highway, a variance of 101 feet . The applicant also requests a variance from Section 21. 7.2 to allow the same storage shed to be located 40 feet from the side property line of a RA district, a variance of 10 feet . AREA CHARACTERISTICS The Curtis Heating and Plumbing business is located in the Yancey Mills area southwest of Crozet . This portion of Route 250 is characterized as commercial in nature with several restaurants and general stores. The topography along Route 250 is generally level, however, the Curtis Heating and Plumbing site slopes off dramatically towards the rear of the property. The Zoning Ordinance designates this area as Scenic Highway requiring a 150 foot setback from the right-of-way of Route 250. STAFF COMMENTS The Curtis Heating and Plumbing business is an existing business zoned HC. The owner proposes to construct a storage shed to the rear of the property. Placement of the storage shed on the site is restricted by the topography of the property to the rear and narrowness of the lot adja- cent to the RA district . Staff is of the opinion that a hardship exists based on the following: 1. by reason of exceptional topographic conditions 2. by reason of exceptional narrowness, shallowness, size or shape of a specific piece of property. (reference Section 34.2 of the Zoning Ordinance) STAFF RECOMMENDATION Staff recommends approval of the requested variance based upon staff comments.
