VARIANCE REQUEST
The applicant requests a variance from Section 4.6.3.2 of the
Albemarle County Zoning Ordinance to allow an addition to a
single-family dwelling to be located 53 feet from a right-of-
way, a variance of 7 feet .
AREA CHARACTERISTICS
The applicant ' s property is located in Ivy Woods Subdivision
consisting of 29 residential lots. Lot size averages 2± acres.
Well over 50% of the subdivision has been developed.
ZONING HISTORY
Ivy Woods (Section II ) was approved on October 12, 1978.
STAFF COMMENTS AND RECOMMENDATION
The applicant proposes to build an addition to his home. Con-
struction of the addition towards the interior of the lot , away
from the right-of-way, is restricted by severe slopes. It is
the staff ' s understanding that construction on the rear of the
house compromises its architectural design.
Due to the severe slope toward the interior of the lot , the staff
is of the opinion that a hardship exists (as defined in Section
34.2) . Based on this, staff recommends approval of the requested
variance.

THIS DEED, made this 9th day of March, 1981, by and between
Herman J. Williams and Roberta J. Williams, husband and wife,
hereinafter referred to as the Grantors, and W. Keith Winkler,
single, and Ann Bolton Perkins, single, hereinafter referred to
as the Grantees, whose, address is 3970 Williams Court,
Charlottesville, Virginia, 22901:

That for and in consideration of EIGHTY-EIGHT THOUSAND FIVE
HUNDRED AND NO/100 DOLLARS ($88,500.00) , $18,927.20 of which is
cash in hand paid, the receipt of which is hereby acknowledged,
and the balance of $69,572.80 by the assumption by the Grantees
of certain indebtedness as hereinafter more particularly described,
the Grantors do hereby GRANT, BARGAIN, SELL and CONVEY with
GENERAL WARRANTY and ENGLISH COVENANTS OF TITLE unto W. Keith
Winkler and Ann Salon Perkins as tenants in common the following
described real estate:
All that certain lot or parcel of land, situated
near the intersection of State Route 682 and
State Route 787, in Albemarle County, Virginia,
further described and designated as Lot 7,
i - containing 2.35 acres on a plat of Section Two
'Ivy Woods", prepared by R. O. Snow and
Associates, dated March 8, 1978, revised
April 19, 1978, and October 6, 1978, of record
in the Clerk's Office of the Circuit Court of
said County in Deed Book 657, page 340, and
being the same property conveyed to the Grantors
herein by deed of Michael Eakin and Toby J.
Eakin, husband and wife, dated June 24, 1980,
and recorded in the Clerk's Office aforesaid
in Deed Book 695, page 716.
Reference is made to said deed and plat for further more
particular descriptions of the property herein conveyed.
This conveyance is subject to the subdivision declarations,
