Gordon TAX MAP/PARCEL: 40/38B(1) ACREAGE: 8. 56 acres (part of) ZONING: RA (Rural Areas) LOCATION: East side of State Route 810, ± .6 mile south of its intersection with Route 680 VARIANCE REQUEST The applicant is requesting relief from Section 10. 4 of the Albemarle County Zoning Ordinance to allow an existing house to be located 53 feet from the front property line, a variance of 22 feet . AREA CHARACTERISTICS The Gordon property is bordered on the north by vacant (open field) land, and to the south by a single-family residence. On the oppo- site side of State Route 810 or the west is a single-family house and the Batna Farm property. Most of the general area is agricul- ture in nature. A stream flows through both proposed parcels A and B. The house on parcel A was constructed years ago and parcel B is vacant . The existing residence is served by a private water and septic system. COMPREHENSIVE PLAN This area is designated Open Space on the Urban Land Use Plan or a maximum density of two (2) acres per dwelling unit . STAFF COMMENTS The Gordons would like to subdivide the existing 8. 56 acre parcel into two (2) parcels. Parcel A has an existing house located within the required setback. There is a nonconforming structure which status would be changing due to the proposed subdivision of the property into two (2) parcels. Staff cannot find any undue hardship, special conditions, unique circumstances, or reason that would restrict the use of the property to its most beneficial use, based on the standards used for granting a variance. STAFF RECOMMENDATION The staff must recommend denial of the variance based on the above standards, however, if the Board wishes to grant the variance the plat submitted meets all other criteria for subdivision approval . .
