LOCATION: Within island of property bounded by Route 6, 753,
and 715, located in Esmont
VARIANCE REQUEST:
The applicant requests a variance from Section 30.5.6.2 .1 of the
Zoning Ordinance to allow a single-family dwelling to be located
122 feet from Route 6 (Scenic Highway) , a variance of 28 feet .
The applicant also requests a variance from Section 10.4 to allow
the dwelling unit to be located 41 feet from the right-of-way of
Route 753, a variance of 34 feet .
AREA CHARACTERISTICS
This area is rural residential in character. Moderately dense
residential development exists along Route 6, Route 715(Esmont )
and Route 627.
STAFF COMMENTS AND RECOMMENDATIONS
The dwelling unit under consideration, exists on an island of
property bounded by Routes 6, 753, and 715. According to Real
Estate Assessment records, the dwelling unit is quite old and is
in need of repair. The owner proposes to renovate the structure
and expand towards the rear of the property (away from Route 6) .
The applicant is seeking setback variances to accomplish this.
The staff is of the opinion that a hardship would exist with the
strict application of the Zoning Ordinance in this case for the
following reasons.
1. The applicant ' s setback situation was created by events over
which he had no control. In this instance the applicant had
no significant control over where VDH&T placed road right-of-
ways. Subsequently, full and reasonable use of the applicant ' s
property is restricted because of the state roads that bound
his property.
2. This is a condition not generally shared by others in this
area and is therefore unique.
3. No substantial detriment to adjacent property owners will
occur nor will the character of the zoning district change
should this variance be granted.
Based upon the above, staff recommends approval of the requested
variance.

Feh THISr DEED OF GIFT, made and entered into this 14th
day of 1y985, by and between GLENDORA S. MILLER, a widow,
party of the first part, and the grantor herein, and
MATHEW D. MILLER and ROSANELL T. MILLER, husband and wife,
parties of the second part the grantees herein whose address
is P.O. Box 42, Esmont, Virginia 22937.
WITNESSETH:
That for and in consideration of the sum of One
Dollar, cash in hand paid, the receipt of which is here-
by acknowledged by the party of the first part, the said
party of the first part does hereby give grant and convey
with SPECIAL WARRANTY OF TITLE unto the said MATHEW D.
MILLER and ROSANELL T. MILLER as joint tenants by the entirety
with full rights of survivorship as at common law the fol-
lowing described real estate, to wit: all of that certain
tract or parcel of land lying and being situated in the
Scottsville Magisterrial District of Albemarle County, Vir-
ginia containing 2.55 acres, more or less, between Route
6 and State Route 753, and further described as Tract A
on a plat of 0. R. Randolph, dated September 28, 1954,
entitled "Plat of Parcels 'A' and 'B' Esmont, Virginia,
for George Moyer," of record in the Clerk's Office of
the Circuit Court of Albemarle in Deed Book 315, page 403.
BEING the same property in all respects conveyed to Carson
S. Miller and Glendora S. Miller by deed of L. George
Kirby and Katherine C. Kirby, his wife, and Dalene K. Craig
and Harry Craig, her husband dated June 25, 1979 and recorded
in the above mentioned Clerk's Office in Deed Book 676 at
page 240. Carson S. Miller having died in 1984 and all
of his right title and interest in said property having
passed to Glendora S. Miller by operation of law.
The Grantor reserves for Carson S. Miller, Jr. , until
February 14, 2000, the right of first refusal should the
Grantees decide to sell the subject property and receive
a bonafide offer of purchase. Grantees shall give written
notice with a copy of the offer received to Carson S. Miller,
Jr. at his residence. Carson S. Miller, Jr. shall then have
30 days in which to exercise hie right to purchase on the
same terms and conditions as the offer. If Carson S. Miller,
Jr. exercises his right to purchase, closing shall occur

30 days thereafter subject to the Grantees being able to
deliver good end marketable title free of liens and en-
cumbrances. If Carson S. Miller, Jr., after notice, does
not exercise his right to purchase within the 30 day
period, but the Grantees thereafter do not convey to the
parties shown on their written offer to purchase included
with the,notice, the right of first refusal shall continue
in effect for the benefit of Carson S. Miller, Jr. until
February 14, 2000.
