LOCATION: In the southeast quadrant of the intersection of
Route 6 and Route 722
VARIANCE REQUEST
The applicant requests relief from Section 4.6.3.2 of the Albemarle
County Zoning Ordinance to allow a swimming pool to be located 24
feet from Route 722 road right-of-way, a variance of 36 feet.
AREA CHARACTERISTICS
Fronting on both Route 6 and Route 722 is the applicant ' s lot .
Only the corner portion of the 6 acre lot has open area, which
surrounds the dwelling. A shallow depth of trees which spans
most of the frontage on Route 722 and the entire frontage of
Route 6, provides screening from both roads. Elevation of the
lot at the scenic setback of 150 feet from Route 6 is approximate-
ly 15 feet higher than at road frontage. The residence is located
approximately 85 feet from Route 722 on a knoll . A gradual slope
to the land exists from the rear of the house toward Route 722.
On the front side of the house, the land drops more radically down-
ward toward the wood line. A level area to the rear of the house
is where the proposed pool would be located.
There are two (2) residences that can be partially seen from the
applicant ' s. All other surrounding property is heavily wooded,
and undeveloped.
The applicant 's property is served by private septic and well .
At the northwest corner, to the rear of the house is the septic
location, adjacent to the proposed swimming pool location.
COMPREHENSIVE PLAN
This area is designated Open Space on the Urban Land Use Plan
or a minimum density of two (2) acres per dwelling unit .
STAFF COMMENTS
The house located just beyond the scenic highway setback eliminates
that area for location of the pool . Limited area exists at the rear
of the house because of the septic location and the house setback.
Overall , there is a small space within which to locate the proposed
pool at the required setback.
The applicant ' s property has physical characteristics and practical
conditions that warrant the proposed location of the swimming pool .
Granting the variance should not have any adverse effect on the
adjacent properties.

W I T N E S S E T H :
For and in consideration of the natural love and affection
which the said Joseph E. and Jean Brochu have for their daughter, the said
Judith G. Brochu, the said Grantors do hereby GIVE, GRANT and CONVEY unto the
said Grantee, as her sole and separate equitable estate, free from the control
and marital rights of any present or future husband and free from any curtesy
rights or inchoate curtesy rights of any present or future husband of the said
Judith G. Brochu, all of which are hereby expressly excluded and with the full
and complete authority of said party of the second part to alien, convey,
encumber and otherwise deal with and dispose of the same without the necessity
of joinder by or with any present or future husband of the said Judith G. Brochu,
all that certain lot or parcel of land, together with the improvements thereon
and appurtenances thereunto belonging located at the intersection of State Route 6
and State Route 722 southwest of Esmont in Albemarle County, Virginia, and
containing 6.224 acres, more or less, as shown on plat of Thomas D. Blue, Civil
Engineer & Land Surveyor, dated May 1, 1979, attached hereto and made a part of
this deed, being a portion of the property given to the said Joseph E. Brochu by
deeds of gift from May B. Hamner dated January 1, 1974 and March 9, 1978, respect-
ively, of record in the Clerk's Office of the Circuit Court of Albemarle County,
Virginia, in Deed Book 644, page 460 and Deed Book 644, page 474 respectively.
Reference is hereby made to the above-mentioned plat and the above-mentioned
deeds for a more particular description of the property hereby conveyed.
