APPLICANT/APPELLANT: Carrboro Limited Partnership, L.L.P.
Background: The request for a determination of the number of parcels of record and
development rights was made by Peter Wiley, on behalf of Carrboro Limited Partnership,
L.L.P., on December 12, 2018. In the application, the applicant suggested that Tax Map
16, Parcel 30 is made up of 5 parcels of record despite being shown as only one parcel in
Albemarle County's real estate records. Section 10.3 of the Zoning Ordinance provides
that a parcel of record zoned RA, Rural Areas that existed in that zoning district on the
date of the adoption of the ordinance, December 10, 1980, was allotted up to five
development rights.
Description of Property: According to current real estate assessment records, Tax Map
16, Parcel 30 contains 822.78 acres+/- (Attachment A). The parcel is physically divided
by State Route 671, Wesley Chapel Road. There are two dwellings located on the parcel.
The dwelling at 5662 Wesley Chapel Road has access to and is located on the portion of
the parcel that lies to the west of Wesley Chapel Road. The dwelling at 5833 Wesley
Chapel Rd has access to and is located on the portion of the parcel that lies to the east of
Wesley Chapel Rd. The easternmost portion of the parcel additionally fronts on State
Route 601, Free Union Road.
Determination and Applicant's Appeal: On January 17, 2019, Kevin McCollum, acting
as designee of the Zoning Administrator, issued a determination that Tax Map 16, Parcel
30 is one (1) parcel of record, comprised of approximately 822.78 acres+/-, and
containing four (4) theoretical development rights (Attachment B). The appellant
contends that this property is five (5) parcels of record, with twenty-four (24) theoretical
development rights (Attachment Q.
Procedure to Determine Parcels of Record and Number of Development Rights:
Parcels of record and development rights are determined in accord with a deliberate and
consistent process. The Zoning Administrator (or designee) first identifies the most recent
deed for the parcel that was recorded before December 10, 1980, the date of adoption of
the ordinance. The number of parcels of record is based on the description of the property
in that deed, in accord with established legal principles. A "parcel of record" for the
purposes of determining development rights is defined as a "lot shown on a subdivision
or other lawful plat or a legal description which is lawfully recorded in the Clerk's Office
of the Circuit Court of Albemarle County, Virginia," prior to December 10, 1980. Up to
five theoretical development rights may be allocated to each parcel of record.
Development rights are allocated solely based on parcels of record.

Grounds for Zoning Administrator's Determination:
The determination in question focused on Deed Book 647, page 258. This deed was the
last deed recorded before the adoption of the Zoning Ordinance and therefore, the deed
used to determine parcels of record and development rights. All deeds referenced are in
Attachment D.
The determination that Tax Map 16, Parcel 30 is one (1) parcel of record, containing four
(4) theoretical development rights was influenced by (1) the language of Deed Book 647,
page 258, (2) the accompanying plat, and (3) the 1979 Albemarle County tax map.
First, the determination focused on the language of the deed, pictured below.

unto Oakencroft Land Corporation, all that certain tract or parcel

The determination noted that the legal description is of a singular nature; "all that
certain tract." This language implies that the land being conveyed is one singular parcel
of 843.79 acres. The statement towards the end of the paragraph, "The property hereby
conveyed was acquired by James F. Lewis, Jr. as follows," and the list of parcels only
provides a record of land acquisition and provides the origin of the parcel, aggregating
843.79 acres. The lack of any language that would suggest that Parcel 30 is made up of
the five listed parcels suggests that the 843.79 acre "certain tract or parcel of land" was
one parcel of record on the date of this deed and the date of the adoption of the Zoning
Ordinance. This is a consistent practice in rendering these determinations.

Second, the determination focused on the plat that was recorded with the deed, Deed
Book 647, page 258 (Attachment E). The Zoning Administrator focused on the drawn
parcel lines as well as the accompanying plat description. The plat shows a singular
parcel boundary line surrounding the total of 843.79 acres+/-. Additionally, the plat
description, "Plat showing a survey of an 843.79 acre tract," is once again written in a
singular nature and lacks any indication that the parcel depicted is anything more than
one parcel.
Lastly, the determination looked at the Albemarle County tax maps from 1979. These tax
maps are often utilized in parcel and development right determinations because they often
depict the parcels of record that existed on December 10, 1980. These maps, which were
created after Deed Book 647, page 258 was recorded, show Parcel 30 as being one parcel
(Attachment F).
After December 10, 1980, Deed Book 854, page 633 suggests that one development right
was used in the creation of Tax Map 16, Parcel 30B. Deed Book 997, page 60 suggests
that additional acreage was added to Parcel 30B, but no further development rights were
allocated. After Deed Book 997, page 60, Tax Map 16, Parcel 30 contained 822.78
acres+/-, and that is how it exists today.
Based on these deeds, the determination concluded that Tax Map 16, Parcel 30 is one (1)
parcel of record, comprised of approximately 822.78 acres+/-, containing four (4)
theoretical development rights.
The Appellant's Justification for Appeal:
The Appellant contends that the language and parcel reference in Deed Book 647, page
258 suggests that Tax Map 16 Parcel 30 was five (5) parcels of record on the date of the
adoption of the Zoning Ordinance (Attachment B). Further, the Appellant contends that
the plat notes in Deed Book 854, page 633 and Deed Book 997, page 60, recorded after
December 10, 1980, suggest a determination of parcels of record signed by the Director
of Planning. Based on this information, the Appellant argues that Tax Map 16, Parcel 30
contains five (5) parcels of record, with twenty-four (24) theoretical development rights.
Staff Response:
The parcel reference listed in Deed Book 647, page 258 is simply a derivation of title.
The parcel reference only lists how the land was acquired. Additionally, it doesn't detail
acreage, and never suggests that the parcels are individual parcels.
In addition, a determination must focus solely on the language of the deed and the
recorded plat, not the potential intent of the Grantor. In drafting the deed, the Grantor had
every opportunity to convey the property as separate parcels, but instead used consistent
language that refers to the tract of land as one singular parcel.

Furthermore, the plat notes and signatures of the Planning Director in Deed Book 854,
page 633 and Deed Book 997, page 60 are not a determination of development rights.
The effect of the Planning Director's signature is simply an approval of the subdivision,
not a determination or certification of the correctness of every aspect of the plat (i.e.,
measurements and distances). Additionally, the note at the top of the plats suggests that
the notes are for information purposes only. This implies that the notes on the plats are
not legally binding and do not hold weight as a determination of development rights.
Summary:
Determination of parcel and of associated development rights is a careful and deliberate
longstanding consistent administrative practice. LOD2018-00023 focused on the
language of the last deed recorded before the date of the adoption of the Zoning
Ordinance. By focusing on the language and the plat in that Deed (Deed Book 647, page
258), the Zoning Administrator determined that Tax Map 16, Parcel 30 was one (1)
parcel of record with four (4) theoretical development rights. The Zoning Administrator
recommends that the BZA affirm this determination.

The County Attorney and I have reviewed the title information for the above -noted property. It is
the County Attorney's advisory opinion and my official determination that Parcel ID 01600-00-
00-03000 is comprised of one (1) parcel of record, with four (4) theoretical development rights.
The basis for this determination follows.
The Albemarle County Real Estate Assessment records indicate Parcel ID 01600-00-00-03000
contains 822.78 acres and two (2) dwellings. The property is zoned RA, Rural Areas.
The most recent deed for Parcel ID 01600-00-00-03000, recorded prior to December 10, 1980,
the date of adoption of the Zoning Ordinance, is recorded in Deed Book 647, page 258 and is
dated May 25, 1978.

description provides a record of how the property was
acquired, but does not imply that the property contains
the separate parcels A-E. In conclusion, there is not
enough evidence to suggest that parcel 01600-00-00-
03000 was anything more than 1 parcel of record on the
date of the adoption of the zoning ordinance.

Based on these deeds;
Parcel ID 01600-00-00-03000 is determined to be one (1) parcel of record, comprised of

Approximately 822.78 acres+/-, containing four (4) development rights.
The parcel is entitled to the noted development rights if all other applicable regulations can be
met. These development rights are theoretical in nature but do represent the maximum number
of lots contain less than twenty one acres allowed to be created by right. Additional lots of 21
acres or larger can be created.
If you are aggrieved by this determination, you have a right to appeal it within thirty (30) days of
this notice, in accordance with Virginia Code § 15.2-2311. If you do not file a timely appeal, this
determination shall be final and unappealable.
An appeal may be taken only by filing an appeal application with the Zoning Administrator and
the Board of Zoning Appeals, in accordance with § 34.3 of the Zoning Ordinance, along with a
fee of $258 plus the actual cost of advertising the appeal for public hearing.
Applications for Appeal of the Zoning Administrator's Determination are available at the
Department of Community Development located at 401 McIntire Road, Charlottesville, Virginia
22902 or online at www.albemarle.org/cdapps. This form applies to the appeal of a decision of

Our firm represents Carrboro Limited Partnership, L.L.P., a Virginia limited liability
partnership, the fee simple owner of those certain legal parcels of land, designated by Albemarle
County as Tax Map 01600-00-00-03 000, containing 822.78 acres, more or less ("Subject
Property").
Our client is appealing the County's Official Determination of Parcel of Record and
Development Rights, as determined by letter dated January 17, 2019 ("Determination Letter").
The Determination Letter concludes that the Subject Property contains only one (1) parcel of
record, with four (4) theoretical development rights. We contend the Subject Property contains
(5) parcels of record, with twenty four (24) theoretical development rights.
Our dispute with the outcome of the Determination Letter originates from that certain
Deed dated May 25, 1978, recorded in the Clerk's Office of the Circuit Court of Albemarle,
Virginia, Deed Book 647, page 258 ("Subject Deed"). The Subject Deed is the last recorded
deed prior to the County's December 10, 1980, zoning ordinance that established the theoretical
development rights of each parcel of record as of such date. As a result, the property description
used in the Subject Deed is the critical item to examine when determining theoretical
development rights.

In its Determination Letter, the County examined the language of the property description
of the Subject Deed and concluded the following:
The singular nature of `all that certain tract' and `containing in the aggregate'
implies that the aggregate of 843.79 acres was one parcel of record on the date of
the adoption of the zoning ordinance, December 10, 1980. Additionally, the plats
[sic] description states, `Plat showing a survey of an 843.79 acre tract,' implying
that it is one tract of land. The 1979 Albemarle County Tax Maps show it as one
parcel of record as well. Lastly, the deed's description states, `The property
hereby conveyed was acquired ... as follows' before listing the parcel references
A-E. This description provides a record of how the property was acquired, but
does not imply that the property contains the separate parcels A-E. In conclusion,
there is not enough evidence to suggest that parcel 01600-00-00-03000 was
anything more than 1 parcel of record on the date of the adoption of the zoning
ordinance.

underlined in red representing language supporting the County's position and the areas of
emphasis circled in blue representing the language supporting our contrary position.

Despite the above, we contend the property description and related plat referenced one
parcel due to the practical reality that surveying the internal boundaries of all five (5) parcels as
described in Parcel References A-E would have added a substantial cost without any added
benefit to the then owner of the Subject Property. Theoretical development rights did not
become local law until several years after the recordation of the Subject Deed and subject plat.
As a result, at the time the plat was drawn, the then owner would have had no reason to preserve
theoretical development rights by having the surveyor otherwise draw the internal boundaries of
all five (5) parcels.

We acknowledge that a development right was used with the 1985 off -conveyance of that
certain 11.336 acre parcel from Parcel Reference C described in the Subject Deed. That said, in
the plat attached to said off -conveyance Deed, the County, by its Director of Planning,
acknowledged that (i) the 11.336 acre parcel came from the property described as Parcel
Reference C, containing 365.4 acres, (ii) that the 354.06+/- residue of Parcel Reference C had 4
division rights and (iii) the then owner of the Subject Property received five (5) tracts of land
from the Subject Deed, not one (1) tract as otherwise alleged by the County in its Determination
Letter. See the pertinent part of the Plat highlighted below.

Later in 1988, a predecessor in title made a second off -conveyance from Parcel Reference
C of 9.674 acres, as the same was simultaneously combined with the previously described
11.336 acre parcel, for a new total of 21.01 acres. Like in the 1985 off -conveyance described
above, the County, by its Director of Planning, acknowledged that (i) the 344.40+/- residue of
Parcel Reference C had 4 division rights and (ii) the then owner of the Subject Property received
five (5) tracts of land from the Subject Deed, not one (1) as otherwise alleged by the County in
