Chapman TAX MAP/PARCEL: 46/103 ACREAGE: 2. 495 acres ZONING: Rural Areas (RA) LOCATION: Located on the north side of Route 643 approximately one mile southwest of its intersection with Route 649 VARIANCE REQUEST The applicant requests a variance from Section 10. 4 of the County Zoning Ordinance to allow a garage to be located 43 .5 feet from a road right-of-way, a variance of 31. 5 feet ; and to allow a swim- ming pool to be located 18 feet from a road right-of-way, a variance of 57 feet . AREA CHARACTERISTICS This area is rural in character. It is sparsely developed with single-family homes and mobile homes. The applicant ' s property is located adjacent to a Southern Railway Co. line. The topogra- phy in this immediate area exhibits moderate to severe slopes. ZONING HISTORY In July 1982 , the Board of Zoning Appeals approved VA-82-37 for this property. This variance allowed the existing residence to be placed 51.89 feet from the road right-of-way, a variance of 21. 11 feet . Approval of the variance was granted based on severe topographic site conditions. STAFF COMMENT The applicant ' s lot slopes severely toward Route 643 along its south and southwest property line. Coupled with the irregular and narrow shape of the lot , usable lot area is considerably restricted. In accordance with Section 34.2, staff is of the opinion that a hardship would result with the strict application of the Zoning Ordinance. This opinion is based on the following reasons: 1. By reason of exceptional narrowness, shallowness, size or shape of the property; and . . . 2. By reason of exceptional topographic conditions. STAFF RECOMMENDATION Based upon the above, staff recommends approval of the requested variance.
