Bedford TAX MAP/PARCEL: 57/141 ACREAGE: 2 acres ZONING: Rural Areas (RA) LOCATION: Located on west side of Route 708, approximately . 3 mile south of its intersection with Route 738 VARIANCE REQUEST The applicant requests a variance from Section 10.4 of the County Zoning Ordinance to allow an existing single-family dwelling to be located 21.02 feet from the side property line, a variance of 3 .98 feet . AREA CHARACTERISTICS This area is residential in character. Several residential developments of moderate density exist in the area. STAFF COMMENT The applicant ' s home exists on lot #17 in Country View subdivision. The applicant explained that during construction of the home she was assured by the contractor that all required setbacks were being met . This was of particular concern to her because the house (solar) had to be situated on the site to take full advantage of sunlight . However, upon having the house surveyed for closing purposes with her bank, the applicant found that the contractor had built the home within the required side yard. STAFF RECOMMENDATION Due to the extenuating circumstances of this case, the good faith efforts of the owner, and the fact that the dwelling unit has already been constructed, staff recommends approval of the requested variance. „, \. Because of the narrow shape of the lot , ' and the fact that it 's long axis runs northwest to southeast , a variance is sought to extend the northeastern corner of the house (see plan) 3 feet over the 25 foot set -back line such that the dwelling can be oriented with its solar elements facing due south for maximum energy conservation.
