CIVIL ENGINEERING - LAND SURVEYING - LAND PLANNING CHARLOTTESVILLE, VIRGINIA G - STAFF REPORT - VA-85-30 APPLICANT: Tana Heins TAX MAP/PARCEL: 61W(2)/02-E3 ACREAGE: 0.00 ZONING: R-6, Residential LOCATION: Minor Ridge Court (Minor Hill Subdivision) VARIANCE REQUEST The applicant requests relief from Section 4.11.2.1 of the Albemarle County Zoning Ordinance to allow a storage shed to be located 0 feet from the side property line, a variance of 6 feet. AREA CHARACTERISTICS Minor Hill Subdivision consists of attached townhouses where the applicants' properties are located. There are four (4) basic size lots in the development . Interior lots have dimensions of 22 feet x 65 feet and 22 feet x 75 feet . End lots measure 41 feet x 65 feet and 41 . 75 feet x 75 feet respectively. Townhouse units are in groups of 6 in each block section. The shorter units of the 22 foot range are located on the 75 foot lots. Front setbacks vary a couple feet on the units, to break the uniform pattern on straight line construction. Most all lots in the subdivision development are of level topogra- phy. There are easements for utilities, and recreation access that have to be spoken to later on. COMPREHENSIVE PLAN The Urban Land Use Plan designates the immediate area for High Denisty Development (11-34 units per acre) AGENCY COMMENTS Any proposed building located less than 6 feet from a property line is subject to building/fire code regulations and further specific information, and permit may be obtained through the County Inspections Department . No structure may be so located on a utility easement , unless written approval can be obtained through the appropriate agencies (Service Authority, Gas Company, Telephone Company or etc. ) . Nor STAFF REPORT - VA-85-30 Page 2 STAFF COMMENTS In reviewing the proposed variances we found common conditions among all variances. One factor, is basically the same size lot, on all but VA-85-31. The usual factors that support the recommendation for granting a variance are hard to define for all such cases. We find that the applicants are restricted in the use of the property by the area involved 22 ' x 22' less the required setback 6 ' and 6 ' , leaving 228± square feet . Variance, VA-85-31, has a 41 foot lot (in width) or 902 square feet less 6' and 6 ' , leaving 560 square feet . All facts pertaining to any applications should be presented to the Board. Republic Homes is responsible for the location of all , but two of the storage buildings located in the subdivision at the time of the Bentley ' s application. Notices were supposedly sent to the homeowners by Republic Homes giving information about meeting required locations and obtaining permits. Building permits were obtained, but not until the buildings had already been located on the properties. STAFF RECOMMENDATION Based on the foregoing we recommend the following: A) Any approved variance is subject to the BOCA building/ fire code regulations. B) Any variance approved pertaining to or regarding a utility easement be subject to written approval from any appropriate agency. Tony Waterfield Republic Homes, Inc . 2788 Hydraulic Road Charlottesville, VA 22901 RE: Residential Accessory Buildings/Storage Sheds Dear Tony : Please .be advised that storage sheds and other accessory structures constructed for private use in connection with residential one and two family dwelling units are required to have a fire separation of six (6) feet to the closet interior lot line or twelve (12) feet between two buildings on the same property . A frame, combustible, structure con- structed less than six (6 ) feet requires a one (1 ) hour fire separation wall for the wall facing the property line . This is the requirement of the Virginia Uniform Statewide Building Code (1981 BOCA - Table 401 ) . Note : If two such structures are attached at a property line they may be constructed with two - one hour walls or one - two hour corrnonwall . Enclosed you will find a letter from the president of that Homeowners Association that states the purpose of that common area and that no buildings would ever be located there. The storage sheds that apply are on the following permit numbers: 84-914, 85-75, 85-80, and 85-81. We are in the process of applying a 1/2 inch fire code plywood fire barrier to the side wall of those sheds that are closer than the allowed six feet to an adjoining property line.
