LOCATION: Located on south side of East Market Street in
the Woolen Mills area
VARIANCE REQUESTED
The applicant requests a variance from Section 15.3 of the County
Zoning Ordinance to allow an existing structure to be located 16. 32
feet from a public right-of-way, a variance of 8.68 feet .
AREA CHARACTERISTICS
This area is residential in charcter. The applicant ' s property
is located just outside the City limits on East Market Street
opposite the Rivanna River and dam. The topography along the
applicant ' s side of this portion of East Market is several feet
higher than the street .
ZONING HISTORY
On October 17, 1984, the Board of Supervisors approved ZMA-84-21
to rezone this property from LI to R-4. The applicant proposes
to renovate an abandoned power plant into a duplex.
STAFF COMMENT
The applicant ' s proposal to renovate the old power plant into a
residential use is compatible with the Comprehensive Plan. In
order to legally use the existing structure for the proposed use,
the applicant is required to seek a variance because the structure
is closer to the street right-of-way than the Zoning Ordinance
allows. Staff is of the opinion that a hardship exists due to the
unique facts of this case. First , the Board of Supervisors has
approved the rezoning; secondly, the property could not be reason-
ably used without a variance; and finally, the variance will create
no detrimental effect on adjacent properties. Moreover, the new
residential use would serve to enhance the residential character
of the neighborhood.
STAFF RECOMMENDATION
Staff recommends approval of the requested variance based on the
above comments.

Dear Mrs. Van Yahres:
This letter is to confirm our conversation regarding the above
referenced property of today. This parcel, now zoned R-4 (ZMA-84-21) ,
has an existing structure which was formerly used as a power plant.
You are proposing to convert this structure into a duplex. Public
water and sewer will be provided as well as off street parking.
As we discussed, no. site plan will be needed. However, the existing
structure must comply with Section 15.3 of—the Albemarle County Zoning
Ordinance regarding setbacks. As this structure does not comply with
Section 15.3, (i.e. , specifically the front setback) , it is my under-
standing that you intend to make application for a variance.

Please call oui office and arrange a meeting with Michael Tompkins,
Zoning Administrator or Andrew Evans, Deputy Zoning Administrator,
at the time you submit your variance application. Mr. Tompkins
or Mr. Evans meet with all applicants as they are responsible
for making a recommendation to the Board of Zoning Appeals.
