TAX MAP/PARCEL: 112/23D ACREAGE: 2 . 891 ZONING: RA (Rural Areas) LOCATION: West side of Route 20 south , at the intersection with Route 720 VARIANCE REQUEST The applicant requests relief from Section 30 . 5. 7 . 2(e) of the Albemarle County Zoning Ordinance to allow a location sign to be 7 . 31 square feet , a variance of 1 . 31 feet . Also, requests relief from Section 30 . 5 . 7 . 1 to allow a location sign to be ne (1) foot from Route 20 right-of-way, (scenic highway) , a variance of 4 feet; and relief from Section 10 .4 to allow sign to be 1 foot fr oute 720 , a variance of 74 feet . AREA CHARACTERISTICS The physical location of the applicant ' s business is beyond the end of state maintenance of Route 720 . A proposed location sign for notifi- cation of the business will be at the intersection of Routes 720 and 20 south . Except for a multi-residential use on the east side of Route 20 , the immediate rural area is comprised of mostly small parcels with single- family houses . There is some pasture , and forestry areas too. A single family residence is existing on parcel 23D (Lot 5) where the proposed sign is to be located . This parcel is located on a curvature of Route 20 south . The intersection of Route 720 and Route 20 is the lowest elevation of parcel 23D . PREVIOUS ZONING HISTORY The Board of Zoning Appeals on their October 9 , 1979 regular meeting, heard VA-79-48 requesting relief from Section 18-3-2 (then provisions of Scenic Overlay District) which was denied . The applicant , Michael and Lynn Bowles , made the petition on property known as County Map 112 , parcel 18J (also located on Route 20 south) . AGENCY COMMENTS The Virginia Department of Highways reviews signs of above six (6) feet in aggregate area . Since the applicant is requesting a proposed location adjoining the state ' s right-of-way, it would be more than proper for them to present their specifications for approval . CORRECTED COPY Page 2 Staff Report - VA-85-38 Montdomaine Cellars , Inc . STAFF COMMENTS The applicant does have the need for a sign for notification of the business . The following points of pretension were made once the property loca- tion was examined : 1) The lowest point of elevation on parcel 23D is the nearest point to both Routes 720 and 20 . 2) The parcel is located on the curvature of Route 20 south as men- tioned previously. 3) Visual access of the intersection of the two (2) roads traveling south is very poor due to a combination of property elevation and road curvature . 4) Route 20 south has a eighty (80) foot right-of-way. A setback of seventy-five (75) feet , plus forty (40) feet to the centerline of Route 20 would make a total of 115 feet . Traveling at an esti- mated 50 to 55 m.p .h . , you would not have adequate time to view the sign and make the required turn onto Route 720 . Based on the foregoing the staff is of the opinion that the applicant has somewhat of a hardship, but the amount of setback is , and could be a judgement call . Tucker, Jr. , Deputy County Executive and Acting Planning Director DATE : August 12 , 1985 RE : Request for Sign Variances , Montdomaine Cellers , Inc. Tax Map 112 , Parcel 23D Given that Route 20 South at the entrance to the Montdomaine Vineyard is not scheduled to be widened in the foreseeable future and the fact that an 80 foot right-of-way exists at that section of the roadway, I would recommend that a 49 foot setback variance be granted to Montdomaine Vineyard to locate its sign 1 foot from the right-of-way. Additionally, I would recommend that a size variance be granted to the Vineyard to allow its sign to be 7 . 31 square feet as requested. Since the right-of-way appears to be fairly wide in this area, this size sign appears to be reasonable .
