across from Fitz' s Auto Sales at the intersection
of Route 742 and Route 1101
VARIANCE REQUEST
The applicant requests relief from Section 26. 10.1 of the Albemarle
County Zoning Ordinance to allow Astec' s freestanding sign to be
located 30 feet from the public road right-of-way, a variance of
20 feet ; and also to erect a second freestanding sign (Unogen) to
be located 15 feet from the public road right-of-way, a variance
of 35 feet .
AREA CHARACTERISTICS
The site is located just south of the Corporate City Limits on
Route 742 (Avon Street Ext . ) . Adjacent to the applicant ' s property
on Route 1101 to the west is Battens Body Shop (Automotive Repair) .
On the opposite side of Route 1101 is Fitz' s Auto Sales (used car
sales lot ) .
Phase I is complete , and the applicant , and one (1) additional
occupant will utilize the variance request .
Elevation of the property ranges from 360 Flood Plain Limits on
the northeast portion adjacent to Moores Creek to 420 at the
southwestern boundary where the main entrance from 1101 was
established.
Landscaping (trees) are located on the site running parallel
with Route 742 (Avon Street Ext . ) , thus obstructing most visual
access from the public road. The road elevation is anywhere
from three (3) to fifteen (15) feet below the developed site area.
ZONING HISTORY
There is an approved site plan that indicates two (2) phases of
development . Variance, VA-85-22, was approved by the Board of
Zoning Appeals on June 11, 1985. The Board of Zoning Appeals
granted a variance to allow a freestanding sign to be located
30 feet from a public street right-of-way , a variance of 20 feet ;
and also to erect a second freestanding sign to be located 15
feet from public street right-of-way.

COMPREHENSIVE PLAN
The Urban Land Use Plan indicates Industrial zoning on both the
west and east sides of State Route 742 from the Corporate City
Limits south to the crossover of I-64.
STAFF COMMENTS
The applicant has made application to reverse the location of the
signs as submitted under VA-85-22 and to increase the aggregate
area of one (1) sign by 9 feet-1.
Traveling southward on Route 742, limited visual access of the
building varies at different intervals because of the road eleva-
tion vs. the site elevation.
Northbound on Route 742 you are able to have visual contact with
the site at present , but probably future vision of the building
will be obscured when the trees mature located parallel with the
road.
The required setback of fifty (50) feet cannot be located except
at the entrance island for location of a sign. If a sign were
located at the required setback, it would only be partially visible
from the public road.
Physical conditions exist on the prepared site preventing the
applicant from locating a sign at the required setback.
The enlargement of the Unogen sign can be justified because of the
setback location, and topographic conditions at the site.
The proposed location of the Astec sign will cause it to be more
noticeable due to its aggregate area, but should be subdued some-
what once the greenery or landscaping begin to mature.
The applicant is asking for a reversal of the two (2) sign loca-
tions, and an increase of aggregate area on one (1) .
The applicant is being restricted because of the required screening,
elevation of the site vs. road level , and the topographic conditions
of the north end of the property.
STAFF RECOMMENDATION
The staff recommends approval of the variance as submitted.
