The applicant is resubmitting a request for a variance. The facts presented in the previous staff report have not changed. Conse- quently , staff respectfully resubmits that staff report for your review of this case. MET/mv STAFF REPORT - VA-84-61 APPLICANT: Ernest & Edna Bruce TAX MAP/PARCEL: 58/55 ACREAGE: 5.3 acres ZONING: RA (Rural Areas) LOCATION: Located on east side of Turner' s Mountain Road off Route 676, approximately .2 mile north of its intersection with Route 250 VARIANCE REQUEST The applicant requests a variance from Section 10. 4, Area and Bulk Regulations (Gross Density Requirements) of the Zoning Ordinance to allow three dwelling units on 5.3 acres, a vari- ance of . 7 acres. AREA CHARACTERISTICS Currently, a single-family dwelling and a rental cottage exist on the applicant ' s property. The applicant ' s property is located in a moderately developed area of the County. The property is located a little more than a mile from Ivy and immediately adjacent to Glennaire and Whispering Pines subdivisions. ZONING HISTORY A building permit (83-1475AC) was issued in November 1983 for renovation of the Bruce 's basement . The renovation created a kitchen, living room, bathroom, and a bedroom. The building per- mit clearly notes that this portion of the dwelling unit is not to be rented. A copy of this building permit is attached to the staff report . STAFF COMMENT The Zoning Administrator has worked with the Bruce ' s since this case has become an issue. Attached to this staff report is a letter from the Zoning Administrator to the Bruces dated August 7, 1984. This letter explains the situation to the Bruce ' s and offers an alternative. It is staff ' s opinion that the Bruces were not aware that this "unit" could not be rented and, therefore, proceeded as if it could. Unfortunately, this case is directly related to the Montgomery case, reviewed by the Board at it ' s June 1984 meeting. The Montgomery case (as well as this case) was concerned with when a variance is construed to be a rezoning. In such cases, to grant a variance altering permitted densities would be tantamount to a rezoning which is an action exclusively reserved for the Board of Supervisors.
