ZONING: HC LOCATION: Located on south side of Route 250 West , at its intersection with Old Ivy Road VARIANCE REQUEST The applicant requests a variance from Section 30.5.6 .2. 1. to allow the construction of an addition onto the rear of an existing structure to be located 60 feet from the right-of-way of Route 250 West , a scenic highway, a variance of 90 feet . AREA CHARACTERISTICS This area is characterized as commercial with several business establishments existing along 250 West . The applicant ' s property exists immediately adjacent to St . Anne ' s School and diagonally opposite University Shopping Center and Ivy Square Shopping Center. STAFF COMMENT The applicant proposes to enclose an existing lean-to and slightly enlarge it to an overall enclosure measuring 24 feet by 20 feet . This structure will be located totally behind the existing gas station and is not visible from 250 West . The gas station is a nonconforming structure. Currently, the lean-to structure is used to wash and wax cars. The proposed structure will be used for this same activity plus provide some storage space. Staff is of the opinion that a hardship exists because the size (area) of the lot makes it impossible for the scenic highway setback to be met . This limited expansion would not detrimentally affect adjacent property owners, nor would it change the character of the district . Also, the expansion would not be seen from the adjacent school due to an existing earth berm. RECOMMENDATION Based on the above , staff recommends approval of the requested variance.
