Shifflett , Etal . TAX MAP/PARCEL: 56A1/01-24A ACREAGE: . 50 ac. ZONING: R-2 LOCATION: Located in Crozet on St . George Ave . (SR-1202) approximately .5 mile west of its intersection with Route 810. VARIANCE REQUEST The applicant requests a variance from Sections 5.2 .2.1. (b) 14.3 to conduct a Home Occupation, Class B in an existing accessory structure which is located 6 . 5 feet from the side property line, a variance of 3.5 feet . AREA CHARACTERISTICS The immediate area in which the applicant ' s property exists is characterized as residential . Several single family dwellings exist on 2 to one acre sites. ZONING HISTORY The applicant received administrative approval of SP-85-80 allowing a Home Occupation, Class B. During the review of this case, the existence of a setback problem was not ascertained, hence the reason for this variance request . PUBLIC AGENCY COMMENTS VDH&T has reviewed and approved the home occupation request without additional entrance requirements. The applicant will meet all building code regulations regarding the operation of the ceramics shop. STAFF COMMENT As stated above, the applicant has received approval for a Class B Home Occupation. The applicant proposes to use an existing outbuilding (see sketch) to operate a small ceramics shop. The existing accessory structure exists 6. 5 feet from the side property line. Usually, an accessory structure can be located as close as six (6) feet from a side property line in accordance with Sections 4. 11.2. 1. and 4. 11 .3. However, Section 5.2. 2.1 (b) - Home Occupation states that the accessory structure must meet the same side yard setback as the main structure. In the R-2 district , the side yard requirement is 10 feet . STAFF REPORT - VA-85-48 Page 2 RECOMMENDATION The size of the applicant ' s lot somewhat limits its use. Staff is of the opinion that a variance for 3.5 feet would not detrimentally impact adjacent property owners, nor would it change the character of the zoning district .
