ZONING: RA (Rural Areas) LOCATION: Located on the west side of State Route 785, approximately . 5 mile north of State Route 649 VARIANCE REQUEST The applicant requests relief from Section 10. 4 of the Albemarle County Zoning Ordinance in order to divide the parcel into two (2) lots, each containing approximately 5.99 acres, providing only 210 feet of road frontage on the south lot ; a variance of 40 feet of road frontage. AREA CHARACTERISTICS Traveling north on State Route 785, you pass by a number of single family residences located on individual lots and the Northwood Mobile Home Park before arriving at the applicant ' s property. The applicant ' s property is located in a rural setting that consists of wooded and open field area. Only one (1) residence presently exists on the property. A private well and septic system serve the single residence. COMPREHENSIVE PLAN The Urban Land Use Plan designates the area as open space. The random location of residences is customary to the character of such areas. The requirement of 250 feet of road frontage is to deter strip development along rural roads . AGENCY COMMENTS The approval of any residential construction would be subject to Health Department approval of their septic systems respectfully. A newly created entrance would be subject to the Virginia Department of Highways and Transportation approval . STAFF COMMENTS The division of land in the rural areas is a very common occurrence. There are several alternatives the applicant has to accomplish the division of the 11+ acre parcel . If the road frontage of the exist- ing parcel were divided equally, there would be ample amount for two (2) parcels. STAFF REPORT - VA-85-51 Page 2 An easement could be created over the existing entrance road to provide access to the proposed new parcel . Based on the ordinance provisions and guidelines for granting a variance, a hardship is not evident . The property has no unique shape or characteristics, nor does it exhibit any practical difficulty that would warrant the granting of a variance. The intent of the ordinance would be violated if the standards were altered without proof of a hardship.
