ZONING: RA (Rural Areas)
LOCATION: At the end of State Route 813 approximately .5
mile from its intersection with State Route 712.
VARIANCE REQUEST
The applicant requests relief from section 10.4 of the Albemarle
County Zoning Ordinance to allow a residence to be located 33 . 14
feet from the rear property line, a variance of 1 .86 feet .
AREA CHARACTERISTICS
The applicant' s property is located a short distance outside the
perimeter of the North Garden Village area as designated on the
County Comprehensive Plan.
The six (6)+ acre tract fronts on State Route 813 at the end of
state maintenance. Other than the Augusta Lumber Company operation
on Route 712 at the intersection with Route 813 , most of the
immediate area is comprised of either open farm land or woods.
The applicant chose to locate the dwelling at the rear of the
six (6)+ acre lot .
A private well that serves the property is located near the north-
west property corner and the septic system is more toward the
south property line.
COMPREHENSIVE PLAN
All of the immediate property is rural area and designated Open
Space on the Land Use Plan. Any variance impact would be very
minimum.
STAFF COMMENTS
When construction on the house started, it was first the responsi-
bility of the contractor to make sure it was meeting all County
ordinance setbacks. Second, the zoning inspector should have found
that the location was in violation when the footing inspection was
done.
By being only a 1 .86 foot error, I believe an honest mistake was
made by both parties concerned. A measurement of less than the
required 90° angle was made .

I ask the board to grant a variance because of the unique circum-
stances.
By way of granting the variance it would not be any substantial
deterrent to the adjacent property and would not change the
character of the district .
STAFF RECOMMENDATIONS
A recommendation for approval is recommended to the Board.
