VARIANCE REQUEST
The applicant requests relief from Section 10. 4 of the Albemarle
County Zoning Ordinance to allow a single-family dwelling to be
located within 67. 33 feet from the front property line, a variance
of 7.67 feet .
AREA CHARACTERISTICS
The Wood property abuts the road cul-de-sac of Albino Lane
located within the Running Deer Subdivision. Running Deer
Subdivision consists of more than 100 lots of which over one-half
are developed.
The surrounding land uses consist of more single-family housing
and farm properties.
To the rear of the house the lot slopes downward toward the rear
property line . There is a drainage easement that is located in
front of the house site which extends to the north side of the
property line and then to the rear corner.
The Rural Area properties are served by wells and septic systems.
COMPREHENSIVE PLAN
The applicant ' s property will not be of any impact on the Land
Use Plan .
STAFF COMMENTS
If a yard is reduced below the minimum requirements, thus reducing
the buildable area to unreasonable dimensions, the Board of Zoning
Appeals must view the provisions of light and air, prevention of
travel , prevention of loss of life, health, or property from fire ,
or other dangers.

In this particular case the staff believes the areas of drainage
on the lot , septic system, and particularly the topography
provide basis for relief .
Secondly , the contractor and inspector appear to have made an
honest mistake.
Finally, as per Section 4. 11 . 1 allows covered porches, balconies,
chimneys and etc. to project into any required yard, but not more
than four (4) feet . Therefore, the variance would be as follows:
Required setback 75. feet
Allowance of yard projection - 4.
Allowed setback 71 .
House with 6 foot porch -67.33 "
Variance needed 3 .67
STAFF RECOMMENDATION
The staff recommends that the Board approve the variance.

IN RE: Request For Zoning Variance for
Mr . and Mrs. Stanley J. Wood Property
Dear Mr . Evans :
I am writing this letter as further explanation for the
zoning variance requested by my clients, Stanley and Jean Wood,
for their residence under construction in the Running Deer
Subdivision, Albemarle County, Virginia.
In July, 1985 , Mr. and Mrs. Wood purchased Lot 6 ,
Running Deer Subdivision. After selling their existing residence
in the City of Charlottesville, they then contracted with Mr. 0.
L. Collier to build a residence on this property. They then
proceeded to obtain a construction loan from Jefferson Savings
and Loan Assocition for the building of the residence.
Apparently in locating a building site on their
property, they were forced to select a site reasonably near the
front property line. This site was selected due to the slope and
grade of the property, which necessitated this location in order
to provide proper and adequate drainage for the septic field. In
selecting this site, however , they thought they were back far
enough from the Albemarle County zoning setback requirement of 75
feet. It is my understanding that they thought they were
approximately 90 feet back from the front property line. In
addition, in digging the site, a County inspector was called out
to the site and he, likewise, confirmed that the foundation site
appeared to be sufficiently back from the front property line to
meet the County setback requirements.
It was only upon obtaining a physical survey for the
construction loan, a copy of which is attached hereto, that it
was determined that the foundation was between 73.33 feet and
73.70 feet from the front property line. As you are probably
aware, this is a violation of the 75-foot setback requirement.
In addition, the building plans provide for a six foot wide front
porch, which plans were also submitted and approved by the County
of Albemarle. Accordingly, once the porch is added to the
property, the actual violation will be between 7.30 feet and 7.67
feet. I have sketched in red the proposed porch on the attached
plat.
I am not certain why the violation was created, as both
the builder and the County inspector thought the property was
sufficiently back from the property line. One explanation might
be that the road appears to curve at one part of our property and
this might have caused some discrepency in the measurements.
Nevertheless, as you are well aware, once we proceed to obtain
our permanent financing, this problem will have to be presented
to the lender , at which time we will not be able to obtain any
permanent financing.
It is accordingly the purpose of the attached
application to obtain a variance to allow for the setback
violation of the residence and the porch. It is also my
understanding that there is no need to obtain a variance for the
one or two steps leading up to the porch. I am, accordingly,
not requesting a variance for the steps.
I might also call your attention to the fact that the
nearest neighbor on the adjacent lot is a sufficient distance
from the house location so as not to be affected by the location
of the new house and its proximity to the road. I believe that
the situation at present without a variance will present an undue
hardship for my clients, and authorizing a variance would not
affect generally the other properties in the vicinity, nor would
it be a substantial detriment to adjacent properties.
I trust this letter will provide you and the Zoning
Board of Appeals with sufficient information in order to grant
our requested variance. Please let me know if you need additional
