Board of Zoning Appeals Action VA-2000-34—Tax Map 61A, Parcel 3-14 Dear Mr. & Mrs Nuckols The Albemarle County Board of Zoning Appeals heard your variance application, VA-00-34, on January 3, 2001 The Board ruled (4 0) to approve your request to allow the existing deck to remain subject to the following condition• 1 This variance is for the improvements shown on the physical survey updated on October 27, 1994 by Gary M Whelan, including an existing cinderblock storage room located underneath the existing deck, being no closer to the setback line than the edge of the deck as of January 3, 2000. This variance approval provides relief from Section 15.3 of the Albemarle County Zoning Ordinance and allows the existing dwelling to remain approximately 10 feet, as measured by staff, from the rear property line, a variance of 10 feet. In addition, the Board denied (3.1) the variance request to allow a sunroom to be constructed on the existing deck. If you are aggrieved by this decision, you have a right to appeal the decision within thirty days in accordance with Section 15.2-2314 of the State Code, or the decision shall be final and unappealable.
