DEZIO ATTORNEY AT LAW 414 EAST JEFFERSON STREET CHARLOTTESVILLE, VA. 22901 (8O4)295-4138 December 19, 1985 FILE NO Zoning Department County of Albemarle 401 McIntire Road Charlottesville, Virginia 22901-4596 Re: Salasco Service Corporation/Lot 14, Phase I, Village Square Gentlemen: As attorney for Salasco Service Corporation, I am writing to request relief from Section 15.3 of the Albemarle County Zoning Ordinance to allow a single family dwelling to be located 14.125' from the rear property line. This would require a variance of 5.875' . The reasons for this request are as follows: a) Present zoning restrictions make it impossible to put a home compatible with the other homes in the neighborhood on this lot. b) Anchor Construction Company has designed a home best suited for the lot, but this home cannot be placed upon the lot without some encroachments of the setback line. c) It is my understanding that the normal side yard setback is 15' . Section 4.11.3 of the ordinance should allow this setback to be reduced to 10' since the criteria set forth therein have been met. In particular, Section 4.11.3a permits a 10' side yard if the lot is within a four mile radius of a fire station. The closest fire station is approximately 2.6 miles and is located on the U.S. 250 Bypass. Also, the Seminole Trail Fire Company is located in the four mile radius. According to the Albemarle County Service Authority, there is a fire hydrant located four lots from Lot 14 that is fed by an 8" water main and has water pressure of 83 pounds per square inch according to the latest test. The designed house would be ideal for the neighborhood and the proposed location would be most compatible with the other homes. On behalf of my client, I request this variance. AREA CHARACTERISTICS This area along Rio Road is characterized moderately dense residen- tial development . Penn Park exists diagonally opposite this sub- division . Stonehenge exists further south along Rio Road . ZONING HISTORY Village Square , Phase I , was approved by the Planning Commission on October 27 , 1981 . Since that time several homes have been constructed within the subdivision . STAFF COMMENTS The lot size in this subdivision development are small . The average lot size is about 9000 square feet . Such lot areas obvious- ly make siting of a single-family residence critical to avoid setback encroachment . The applicant ' s lot consists of 8 , 446 square feet . The use of this lot is further restricted due to its irregular shape . STAFF RECOMMENDATION Due to the lot ' s irregular shape and limited area staff is of the opinion that a hardship exists and recommends approval of the re- quested variance . ,• VA - - .
