TAX MAP/PARCEL: 32/42-36 (part of) ACREAGE: 5 . 0 (part of) ZONING: HC (Highway Commercial) with proffer LOCATION: East side of Route 29 North , approximately 200 yards south of the the intersection of Route 29 North and Route 649 VARIANCE REQUEST The applicant requests relief from Section 21 . 7 . 1 of the Albemarle County Zoning Ordinance to allow a canopy to be located 12 feet from the public right-of-way, a variance of 18 feet . AREA CHARACTERISTICS The applicant ' s property is located abutting the northbound lane of Route 29 , approximately 200 yards south of the intersection of Routes 29 and 649 . A commercial carpet business (Mercers) adjoins the applicant ' s property on the north side . Undeveloped land lies to the east , south , and also on the west , or abutting the southbound lane of Route 29 . A proposed convenience store/gas outlet business will be developed on the one (1) plus acre site , having two access points to the highway. One access for entry and the other for exit traffic . ZONING HISTORY The Board of Supervisors on November 8 , 1985 , rezoned the referenced property from R-1 (Residential) to HC (Highway Com- mercial) with proffers . COMPREHENSIVE PLAN The Urban Land Use Plan has all areas abutting both the south and north bound lanes of Route 29 designated for Commercial uses . AGENCY COMMENTS Any encroachment to the road right-of-way is subject to review and possible conditions of the Virginia Department of Highways ad Transportation . STAFF REPORT - VA-85-57 2 STAFF COMMENTS The property to be developed is a one (1) acre plus parcel with a depth of 210 feet . The site will house a convenience store , front canopy to cover six (6) gas pump islands (variance request) , and a rear canopy to provide cover for three (3) gas pump islands located beyond the store building. Span of the canopies will be from the requested setback to a depth of 171 feet or 81% of the property depth . Even though the canopy will not be attached to the convenience store building, the structure must meet the same front setback of thirty (30) feet . Pictures submitted to our office indicate a sign is mounted on the end of the canopy facing the road . It is obvious that the canopy provides weather protection for the gas pump area and would provide more pronounced signage location also. The staff has reviewed the site drawing and found that almost all of the depth of the property is being utilized but minimum width . This use is self-imposed and not created by physical characteristics of the property itself . There is no evident hardship that would prevent the applicant from development of the property. This is a request to rezone 374 acres from R1 to. H .C. submitted jointly by Tri-Ton , Inc . and Hollymead Land Trust. For your consideration, I am submitting 2 sets of Proffers : 1 . The 1st set of proffers covers the original 37+ acres less a 2 . 5 acre parcel (shaded in yellow) that the staff felt was inappropriate. 2 . The 2nd set of proffers covers the 17+ acres that the planning staff has recommended be re-zoned . This is shown shaded in orange on the attached drawing . Smith mo Af Now' -owe Number 2 PROPOSED PROFFERS Covering 17+ acres Tri-Ton, Inc. and Hollymead Land Trust Join together under re-zoning application ZVIA-85-20 to make the following proffers: Proffer #1 The entire Rt. 29 frontage of approximately 1560+ shall be served at only 5 access points, only one of which shall serve as an entrance to a future collector street. A. Access Point 1 (AP1) shall be established at the south end of the property across from an existing crossover (median break) . A decel lane shall be constructed by VDH&T standards to serve this access point. B. Access Point 2 (AP2) shall be established 500' north of AP1 opposite a proposed new crossover which exact location is yet to be determined. A 3rd lane built to VDH&T standards shall be constructed between AP1 and AP2 when AP2 is approved by the VDH&T. C. Access Point 3 (AP3) shall be established 500' north of AP2. A 3rd lane built to VDH&T standards shall be constructed between AP2 and AP3 when AP3 is approved by the VDH&T. D. Access Point 4 (AP4) shall be established 12.5' south of the property line between Piercer Carpets and Tri-Ton and opposite of an existing crossover. A 3rd lane built to VDH&T standards shall be constructed between AP3 and AP4 when AP4 is approved by the VDH&T. E. Access ,Point 4 South (AF4S) shall be built 175' south of AP4 and shall only be constructed if and when AP4 is constructed.
