Wheeler TAX MAP/PARCEL: 80/110B & 113 ACREAGE: 1 .44 acres ZONING: RA, Rural Areas LOCATION: Southwest quadrant of the intersection of Route 22 and Route 731 - Keswick VARIANCE REQUEST The applicant requests a variance from Section 10 .4 of the Albe- marle County Zoning Ordinance to allow an addition to an existing structure to be located 20 feet from the Route 731 right-of-way, a variance of 55 feet . The applicant also requests a variance from Section 4 . 6 . 3 . 2 to allow the same structure to be located 33 feet from the Route 22 right-of-way, a variance of 27 feet . AREA CHARACTERISTICS This area is rural residential in character . The existing struc- ture used to house a country store and the post office . The post office currently occupies the entire existing structure . The topography on site is fairly level. The East Rivanna Fire Company and the old railroad depot exist opposite the structure on Route 731 . The applicant ' s plat of the property shows the old C & 0 railroad right-of-way. This right-of-way no longer exists and the tracks have been removed . STAFF COMMENTS Since the post office now occupies the entire structure , the applicant proposes a 35 X 45 foot (1575 sq. ft . ) addition for the country store area . Section 31 . 2 . 4 . 5 of the Ordinance allows for the expansion of the established uses on this pro- perty. Due to the exceptional narrowness of the lot , staff is of the opinion that an unnecessary hardship would result with the strict application of the Ordinance . Also, the character of the district will not be changed should the variance be granted . Beginning at a point in the existing right of x gay line 40 feet southwesterly at right angles from center line of original main track (now removed) of the Piedmont Sub-Division of the Chespeake and Ohio Railway Company at or near station 9088 plus 98, and being in the Westerly line of Gordonsville-Charlottesville Road; thence northwesterly on right of way line parallel with and 40 feet from said original center line, which is on tangent N 51° 59' W to station 9089 plus 33 and on a 5° 10' curve to the left, a total distance of 461 feet, more or less, to a point redially opposite station 9093 plus 68, and being approximately in th- tc center of Mill Race; thence northeasterly and radially and approximately along said center of Mill Race, 40 feet to a point in said original center line; thence southeasterly along said original center line, as above des- cribed 470 feet, more or less, to a point in the said westerly line of Gordonsville-Charlottesville Road; thence southwesterly along said westerly line of road 41 feet, more or less, to the point of beginning and containing. 0.43 of an acre, more or less. Beginning at a point in the existing right of way line 40 feet northeasterly at right angles from center line of original main track (now removed) of the Piedmont-Sub-Division of the Chespeake and Ohio Railway at or near station 9088 plus 78, and being in the easterly line of Gordonsville-Charlottesville Road; thence southeasterly on right of way line parallel with and 40 feet from said original center line, which is on tangent S 51° 59' E to station 9079 plus 79.3 and on a 3° 30' curve to the left, a total distance of 1493 feet, more or less, to a point radially opposite station 9073 plus 62, more or less; thence southwesterly and radially across said original center line 80 feet to a right of way corner 40 feet southwesterly and radially from said griginal center line; thence northwesterly on right of way line parallel with and 40 feet from said center line, which is on a 3° 30' curve to the right 545 feet, more or less, to right of way corner; thence S 42° 00' W on right of way line 93 feet, more or less, to a right of way corner 129 feet southwesterly and radially from said original center line; thence northwesterly on right of way line 720. 5 feet to another right of way corner 129 feet southwesterly • *t right angles from said center line at station 9086 plus 20; thence 7 \Io1,- _140i northwesterly on right of way line 268 feet, more or less, to a right of way corner in the said easterly line of Gordonsville-Charlottesville Road; thence northeasterly along said easterly line of road 128 feet, more or less to the point of beginning and containing 4. 65 acres, more or less; the two (2) above described parcels of land being more particularly indi- cated in yellow on map hereto attached, as a part hereof, marked for. identification, The Chespeake and Ohio Railway Company, Chief Engineer' s Office, Drawing No. 19318-21, dated May 19, 1948, revised May 25, 1948. This conveyance is made subject to an easement for a roadway over and across the southwest portion of Parcel No. 2, the said easement being located between the depot building and the south line of said parcel, and extending from the Gordonsville and Charlottesville Road on the west side of said parcel to the adjoining property of D. Allen Betts on the south side. This conveyance is also made subject to the provision in deed between Margaret Rogers and Virginia Central Railroad Company dated July 20, 1865, recorded in Deed Book 61, page 193, of the Albemarle County, Virginia, records, which is as follows: "Provided that no store or tavern is to be erected on said piece or parcel of ground, and that no store or tavern is to be kept in any of the buildings of said Company, or appurtenances thereunto belonging, being the land on which the Keswick Depot of said Company is located."
