Boalnd to operate an antique shop at the applicant ' s location. Since the later part of 1983 the antique shop use has been abandoned. COMPREHENSIVE PLAN The Urban Land Use Plan has the immediate area designated OPEN SPACE which allows a minimum density of two (2) acres. STAFF COMMENTS An existing patio will be constructed upon and enclosed to make a room. The patio would provide the foundation for the proposed room structure. The staff made the foregoing findings: The water well is located to the immediate rear of the residence approximately 12+ feet away from the rear wall . A septic system is located on the south side of the structure. Considerable area mostly to the rear or eastern part of the .930 acre parcel is in a flood area or otherwise subject to flood conditions. Physical conditions by way of the well and septic location, topography of the rear section of the property restrains the applicant from adding an addition to the south side and to the east or rear of the existing structure. Since a patio exists on the north end of the house, a form of construction is existing. The proposed addition will not project out into the side yard any further, and will only surpass the front line because of the road curvature. In conclusion we find that the applicant has certain difficulties and an apparent hardship. STAFF RECOMMENDATION Based on the foregoing report , the staff recommends the Board to grant the requested variance. STAFF REPORT - VA-86-01 APPLICANT: T.E. Wood TAX MAP/PARCEL: 33/1G ACREAGE: .930 acre ZONING: RA (Rural Areas) LOCATION: East side of Route 29 North at the intersection of Route 1575 (Austin Drive) adjacent to entrance to General Electric VARIANCE REQUEST The applicant requests relief from Section 10. 4 of the Albemarle County Zoning Ordinance to allow an addition to a single-family dwelling to be located eighteen (18) feet from the road right- of-way, a variance of 57 feet . AREA CHARACTERISTICS The applicant ' s property is located in somewhat of a rural setting, adjacent to the northbound access entrance to the General Electric complex. A make-up of the immediate area consists of several single-family houses, General Electric complex, and the Piney Mountain Restau- rant . Area to the east of the applicant ' s structure is wooded and undeveloped. Some wooded area joins the north property line , and one (1) single-family residence exists about 40 yards beyond the south property line. The proposed addition will be constructed over the existing patio on the north side of the house. Corner of the existing house is 19.8 feet from front property line . Area to the rear of the house is much lower than in and around the front and sides. This property is served by a private well and septic system. ZONING HISTORY The Board of Zoning Appeals in 1978 , (VA-78-40) , granted relief from Section 7-3 to allow a sign to be located adjacent to the road right-of-way, a variance of thirty (30) feet . The Board of Zoning Appeals in November 1979 - heard an appeal concerning a non-conforming sign. Board confirmed decision of freestanding sign not to exceed 18 square feet .
