LOCATION: Located on property adjacent to the southbound
lane of State Route 29, just south of the Greene/
Albemarle County line
VARIANCE REQUEST
The applicant requests relief from Section 10. 4 of the Albemarle County
Zoning Ordinance to allow the outside edge of a canopy to be located
fifteen (15) feet from Route 29 right-of-way, a variance of sixty (60)
feet .
AREA CHARACTERISTICS
Windmill Market is a country store located in a rural residential setting.
The general area consists of residential houses, a mobile home park, and
a commercial office development at the entrance to Lake Saponi .
Applicant ' s property borders with the Greene County/Albemarle County line.
A single gas island that the applicant wishes to construct the canopy
over, is approximately twenty-eight (28) feet out from the store and
about twenty-five (25) feet from the road right-of-way.
An outside drink display is the only other type structure other than
the gas pump island.
COMPREHENSIVE PLAN
The Urban Land Use Plan designates the immediate area OPEN SPACE which
allows minimum density of one (1 ) dwelling per two (2) acres.
AGENCY COMMENTS
The applicant will be subject to review and possible conditions of the
Virginia Department of Highways for any encroachment to the road right-
of-way.
STAFF COMMENTS
The applicant proposes the construction of a 24' x 24' canopy to cover
the existing gas pump island and adjacent travel lanes.
STAFF REPORT - VA-86-02 2
A reduction of any required yard (setback) must be viewed with consis-
tency of adequate light and air, prevention of danger in travel , and
prevention of loss of life, and/or property from fire and other dangers.
A structure of this type is supported by post and will probably be
mounted on the existing concrete island. Its purpose is to provide
covering for the patrons in pursuit of gasoline.
In review of the applicant ' s particular situation, the staff makes
these findings:
The structure will not impede or cause any danger to
travel .
A permanent attachment to the ground will be made to an
already existing fixture located on the site .
The canopy will be a free-standing structure not attached
to the main structure (store) on this site.
Its purpose will serve the public, and provide a safer
environment for the patrons.
No evidence can be found that will show it should have any
detrimental effect on the adjacent properties.
STAFF RECOMMENDATION
The staff can recommend approval of the variance based on its findings.
