LOCATION: On the east side of St . Rt. 627, approximately
2 mile north of the intersection of Rt . 6 and
Rt . 627
VARIANCE REQUEST
The applicant requests relief from Section 10. 4 of the Albemarle
County Zoning Ordinance to allow a freestanding identification
sign to be located seven (7) feet from the public road right-of-
way, a variance of sixty-eight (68) feet . Also, the applicant
requests relief from Section 4. 15.3 .1 to allow a freestanding
identification sign to be forty (40) square feet , a variance of
thirty-six (36) square feet .
AREA CHARACTERISTICS
The New Green Mountain Baptist Church is situated in a rural
country setting on St . Rt . 627. It is located near the village
of Esmont .
Scattered throughout this immediate area is different types of
single-family residences and only about 4 mile away is a country
store .
The church property which borders Rt . 627 is higher in elevation
than the road surface.
Access to the church site is by way of the northwest part abutting
Rt . 627, wherein is also located the sign.
COMPREHENSIVE PLAN
The Urban Land Use plan designates this area as OPEN SPACE, which
allows agriculture and forestry uses. The minimum density is two
(2) acres per dwelling unit .
STAFF COMMENTS
The sign as applied for in the variance request has already been
located on the church property in violation of both setback and
aggregate area.
A brick wall/type sign with glass inserts and reader board was
existing and was removed to erect the new sign. The setback was
probably as close if not closer to the road right-of-way than
the present sign. Approximate size of the entire wall structure
was in the area of 4 x 6 feet .

Any relocation of a sign or structure must conform to both the
setback and area requirements of the ordinance.
Since the old sign does not have any official County record, it
is considered to be nonconforming or prior to the enactment of
the ordinance regulations.
The intent of the sign ordinance regulations is to minimize safety
hazards, and to create an attractive, and harmonious community
through regulation, and control of the size, location, height ,
number and characteristics of sign.
Elevation of the church property is higher than the road surface,
so that itself eliminates some of the hazard of mishap by motorist .
For a sign to be located at the required seventy-five (75) foot
setback would be beyond the church building setback, and thus not
visible from both travel directions.
Several elements of hardship can be found in regard to the required
setback, but no evidence can be found to support the size variance .
In view of the size, type, and material construction of the sign
it is certainly not in keeping with the character of the rural
community setting where as the sign is located.
STAFF RECOMMENDATION
We find that a hardship does exist in regard to the setback and
recommend approval from Section 10. 4.
On the variance for sign size from Section 4.15.3. 1 we recommend
denial for any area above twenty-four (24) square feet , which was
the approximate size of the previous sign.
*Note The Board should apply the condition that should the sign
have to be moved or relocated because additional road
right-of-way is obtained, the church shall burden any
such expense.

The purpose of this letter is to follow up our phone conversation
on Friday, May 23 , 1986 . I noted that New Green Mountain Baptist
Church has made plans to remove the 40 square foot sign and install
a 24 square foot sign to meet the size regulation ( section 4. 15.3. I ) .
I indicated to you that our church officials are bending over back-
wards to work with this situation . While there are no regulations
on lighting , we are trying to work with Mr. Loving , who indicated that
his "property is the only area that is being affected by the present
signu( since it is across the road from his house) . He does have a
street light directly in front of his house and the sign added addition-
al lighting . However, to alleviate this problem, we plan to move
the sign back to the original spot, the location where the church
sign has been for years . Furthermore, we plan to move the sign five
to ten feet from the old spot, away from the highway and toward the
church . This should place the sign directly in front of the church
but yet far enough away to allow a hearse to back up to the church
steps during funerals .
Mrs . Clara Brown , whose house is directly in front of this proposed
area , has indicated that she has no problems with the sign being
in the area . She is a widow and the area is very dark. Furthermore,
our church does not have adequate lighting and this sign will help
provide lighting and security to the front part of our church at
night. We have reduced the number of bulbs from six to four, there-
fore decreasing the amount oflight by comparison to the 40 square
foot sign . Mrs . Clara Brown has indicated that your office could
call her if you doubt the fact that she does not object to the
installation of the sign in front of her house(286-3684) .

We are only requesting that you recommend approval from section
10 .4(setback) as you stated that you would recommend in your
April 4, 1986 letter:
"We find that a hardship does exist in regard to the setback and
recommend approval from Section 10.4 . "

Dr. Horace Rice called the Zoning office and spoke with me
on May 23 , 1986, concerning the variance. He said that the
church would be relocating the sign to another place on the
property near the church building, and the size had been
reduced to the 24 square feet . He wanted to know if the
Board would have any problem with that? I responded in
saying I couldn't speak for the Board, but that what he had
done' was in good reaction to the Board' s concern as discussed
at the April meeting.
